THE CCUSULATE DESK
1. INTRODUCTION: The Consulate Desk of File Research Branch is
concerned with processing requests for information directly from American
Consulates in Germany and Austria. Also, requests from Central Clearance
Unit, American Consulate, StuOrt, Germany, which handles requests from all

other US EMbassies and Consulates. In addition, it services the Canadian and
Australian 'Migration Officer. Normally these requests pertain to persons who
have applied for immigration or visas, and although there are other reasons
for submitting these requests these Offices generally do not indicate ths
reason behind their request - hence alb. are treated identically. (Example
of requests included in Appendix 1 thru 6).
2. REPORTABILITY: Reportable information in response to American
Consulate requests is based'uPon limitations for immigration to the United
States as outlined in Public Law 414. Any information within our files
which would possibly preclude admittance of an individual to the US will
be reported. In any case where reportability is questionable, the best
solution is to report the information and albw:the Consulate to decide
its applicability. All information which is reportable to American
Consulates is also reportable to the Australians and Canadians provided it

DID NOT ORIGINATE with an agency OUTSIDE DEPARTMENT CP DEFENSE (DOD) or
with another ALLIED GOVERNMENT. Where derogatory information exists which o
originated with a foreign government or an agency outside the DOD, our reply
will indicate only where it may be possible for the requestor to receive
additional information.
3. SPECIAL CONSIDERATIONS: .011 Canadian requests, the inclusion of
co-subjects will often be found, which necessitates separate replies for all
individuals. Should they both be No Rec,rd or NDI,s, requests should be
stamped following each name on the request, indicating to the requestor that
all subj,..cts have been file checked by this headquarters. Many instances
occur where a CR file check reveala no information regarding subject of
request, but contain information regarding the spouse of subject. This will
be reported. Accurate reporting and evaluation of all information in answer
to Consulate requests is important in order that no applicant for immigra,-
tion or visa to the US, Canada, or Australia will be accepted or denied
because of a wrongly inteypreted reply. Extract from US Public Law 414
included as Appendix 7.

212 (a) (1): Aliens who are feeble-minded.
212 (a) (2): Aliens who are insane.
212 (a) (3): Aliens who have had one or more attacks of insanity.
212 (a) (4).: Aliens afflicted with psychopathic personality, epilepsy,
or a mental defect.
212 (a) (5)! Aliens who are narcotic drug addicts or chronic alcoholics,.
212 (a) (6): Aliens who are afflicted with tuberculosis in any form, or
with leprosy, or any dangerous contagious disease.
212 (a) (7): Aliens having a physical defect, disease or disability which
may affect the ability of the alien to earn a living, unless
the. alien affirmatively establishes that he will not have
to earn a living.

212 (a) (15): Aliens who are likely at any time to become publio charges.
212 (a) (16): Aliens who have been excluded from admission and deported
and who again seek admission within one year from the date
of such deportation, and who have not obtained the consent
of the Attorney General to re-apply.
212 (a) (17): Aliens who have been arrested and deported, or who have
fallen into distress and have been removed pursuant to this
or any prior act, or who have been removed as alien enemies,
and who are lacking permission from the Attorney General
to apply or re-apply for admission.

Aliens who are stowaways.
Any alien who seeks to prooure, or has sought to procure,
or has procured a visa or other documentation, or seeks to
enter the United States, by fraud or by Willfully misrep-
resenting a material fact.!
Any alien failing to possess a valid passport or other
acceptable travel document, all required.
Any Quota Immigrant whose visa has been issued without
compliance with the provisions of Section 203 (which conoerne
"Quota Immigrants").
Aliens who are ineligible to citizenship, except aliens
seeking to enter as nonimmigrants; or persons who have de-
parted from or who have remained outside the United States
to avoid or evade training or service in the armed forces
in time of war or a period declared by the President to be
a national emergency.
Aliens convicted of violation of laws or regulations re-
lating to the traffic in narcotic drugs or activities per-
taining thereto.
Aliens seeking admission who arrived in contiguous territory
or adjacent islands by nonsignatory or noncomplying trans-
portation lines.
Illiterates. (i.e. Aliens over 16 years of age, physically
capable of reading, who cannot read and understand soMe
language or dialect.)
Any nonimmigrant who is not in: possession of a valid
(minimum six-month period) passport.
