As you Imow, Section 143 of the Atomic Energy Act of 1951i. was amended by Public Law 1006, approved on August 6, 1956, and now reads as follows: "Sec. 143. DEPARTMENT OF DEFENSE PARTICIPATION.-- The Commission may authorize any of its employees, or employees of any contractor, prospective contractor, licensee or prospective licensee of the Commission, or any other person authorized access to Restricted Data by the Commission under Subsection 145b., to permit any employee of an agency of the Department of Defense or of its contractors, or any member of the Armed Forces to have access to Restricted Data required in the performance of his duties and so certified by the head of -the appropriate agency of the Department of Defense or his designee: Provided, however, That the head of the appropriate agency of the Department of Defense or his designee has determined, in accordance with the established personnel security procedures and standards of such agency that permitting the member or employee to have access to such Restricted Data will not endanger the common defense and security; And provided further, That the Secretary of Defense finds that the established personnel and other security procedures and standards of such agency are adequate and in reasonable conformity to the standards established by the Commission under section 745." To implement Section 113 of the Act the Commission has approved the policy of authorizing the Heads of Federal Departments and Agencies other than the Department of Defense to permit their employees or contractor employees who have been cleared by the AEC (excluding such employees who have been cleared by the AEC in connection with an access permit) to grant access to the Restricted Data in their possession to any employee of an agency of the Department of Defense or of its contractors, or any member of the Armed Forces provided that the Head of the appropriate agency of the Department of Defense or his designee certifies in writing that such member or employee needs the access in the performance of duty, possesses appropriate military clearance, and that permitting the access will not endanger the common defense and security. When the transfer of Restricted Data documents or material is _inv llved, the_requirem_ents of_Pa_rts_2100 and 21400 of theABC_Manua shall apply,provided that the-certification required r Section 03 hereof is furnished. The policy-and-procedures in this Chapter are also applicable to civilian and military employees of an agency of the Department of Defense when that agency is acting as a contractor to the AEC. Nothing in-this Chapter shall authorize,-or permit the authorization of any individual who has been cleared by the AEC in connection with an Access Permit issued pursuant to 10 CFR Part 25-to communicate Restricted Data information in his possession to-members_of the Armed Forces or employees of the DOD or its contractors in accordance with the-provisions of this Chapter or-Section 1 3_of the Atomic-Energy Act of-195E. 2318-02 Policy It is the policy of the Atomic Energy Commission to permit its employees and employees of its contractors and licensees and employees of other Federal Departments or Agencies, and their contractors whopossess app ro- 2riate AEC-clearance, to grant access to Restricted Data to an employee of an agency of the Department of Defense or of its_ contractors or to any members of the Armed Forces upon-appropriate-request-in accordance-with the conditions set forth below. 2318-03 Requests for Access to Restricted Data All requests for access to Restricted Data shall be made on Form AEC-277, "Request for Visit or Access Approval," by or in the name of one of the officials listed in AEC Appendix 2318-03. A copy_of the request made-to another Federal Department or Agency shall be forwarded to the Director, Division of Security, AEC Headquarters. -- ? --- _ _ ._ ____ _____ 032 Each request shall include the following: a. Name of person(s), organization represented and, if other than one of the Armed Services, the organization's relationship to the Department of Defense; b. Specific information to which access is requested; c. The military clearance status of each person (Top Secret, Secret, or Confidential); d. Certification that the person needs the s.ccess in the performance of duty; e. Anticipated date of visit and names of persons to be visited, as appropriate;l f. Statement of determination that permitting the persons access will not endanger the common defense and security. 23.18-04 Approving Requests for Access The honoring of requests for access to Restricted Data in possession of AEC employees and employees of AEC contractors and licensees shall be a responsibility of the Manager of Operations or head of Division or Office, Headquarters, or-their-designees. Approval of a request for access to Restricted Data in the_possession of an AEC cleared emFl ee of a Federal Department or Agency (other than AEC and DODT or its contractor shall be the responsibility of the appropriate official listed in Appendix 2318-031 or-his-designee. They may authorize the access after satisfying themselves: a. As to the person's identity; b. That the person's military clearance as indicated in the request is at least equal to the classification of the information to which access is requested; and 7 This sub-section is not applicable to requests for documents or material containing Restricted Data. In such cases the exact address to which such documents or material are to be sent shall be substituted. That they possess authority to afford the access: AEC 2318-05 1. All requests for access involving Top Secret production rates or Top Secret stockpile figures shall be referred for approval to the Director, Division of Military Application, AEC Headquarters. *2. AEC Appendix 2318-031 lists those officials of Federal Departments and Agencies other than the AEC and the Department of Defense who have authority to approve certified requests (other than those covered in OL-c-1 above) for access to Restricted Data in the possession of their employees and contractor employees who have been cleared by the AEC.* 3. AEC Appendix 2318-04 lists the programs, projects, areas of information, and conditions under which designated AEC officials are authorized to approve certified requests for access to Restricted Data in the possession of-employees-of the AEC and its contractors. - - - - - - 2318-05 Honoring of Requests Made to AEC for Access Not Within the Programs, Projects, and Agencies Listed in AEC Appendix 2318-0h. Requests made or referred to AEC for access not authorized by the specific delegations of AEC Appendix 2318-0b shall be forwarded to the cognizant Division, Headquarters, and shall be honored only when such requests have been approved by the appropriate service screening office. 2318-06 Coordination of Requests Within AEC Headquarters Offices and Divisions having operational jurisdiction over matter to which access is requested shall coordinate such requests with other divisions having an interest in such information. 2318-07 Continuing Access Where arrangements are made under the delegations of authority set forth in AEC Appendix 2318-0L or where an agency of the DOD is acting as a con- tractor to AEC or-to another government-aEency, some flexibility in the day-to-day requirements for access covered in this Chapter may be justified. After the formal procedures required by the Chapter for an individual to have access have once been complied with, local arrangements for repeated access (for a specified period not to exceed-one-year') by such individual under the above-mentioned circumstances may be made by the cognizant Manager of Operations or the head of a Division or Office, Headquarters, or the a2propriate official of-another-Federal--Department or AEency listed in Appendix 2310-031.- - - - - - - - - - - - - Revised: February 6, 1957 Approved For Release 2009/01/30: CIA-RDP80BO1676R000700140045-3 Approved For Release 2009/01/30: CIA-RDP80B01676R000700140045-3 flUUL'ls.' 1 1v 1WLJ1L61V 4-- L/Li- -- -d+ ?- ARMED FORCES AND EMPLOYEES OF AGENCIES OF THE 2AEC- 318-08 DEPAIThENT OF DEFENSE AND THEIR CONTRACTORS 2318-08 Access on the Basis of AEC Clearances AEC employees and employees of its contractors and licensees and employees of other Federal Departments or Agencies and their contractors who possess apprcpriate AEC clearance may continue to accept active AEC clearances in lieu of military clearances as a basis for granting access to Restricted Data to an employee of an agency of the Department of Defense or of its contractors, or to any member of the Armed Forces. In these cases, the information described in sub-sections 2318-032c and f shall not be required; however, regular AEC visitor-control procedures shall apply. (See AEC Chapter 2501.) 2318-09 Department of Defense .?ersonnel Assigned for Dut~Lwrith the AEC Notwithstanding the procedures yet forth above, those DOD personnel assigned for duty with the AEC (not with AEC contractors) shall possess AEC clearance and shall, in their assigned capacity, be afforded access to Restricted Data on the same basis as AEC employes. Restricted Data received by such personnel may be disseminated b;y them as DOD representatives in accordance with DOD regulations, provided that, as DOD representatives, they possess appropriate certification as required by the provisions of Section 03 above. 2318-10 Record Keeping Each Manager of Operations and each official of a Federal Department or Agency_listed in Appendix 2318-~3l shall be-responsible-for maintaining a single control index recording those grants of access which have been approved under this Chapter. Heads of AEC Divisions or Cffices, Headquarters, shall forward a copy of each request for access which they have approved to the Director, Division of Security, who shall maintain a similar index for the Headquarters Office. 2318?-11 Liaison The Director, Division of Security, Headquarters, shall maintain liaison with the Department of Defense and other Federal Departments-and Agencies to: a. Assure prompt notification of changes in those positions whose occupants are authorized tc initiate access requests; b. Aid in identifying Managers of Operations cr heads of Divisions or Offices, Headquarters, and officials of Federal Departments and Agencies, to which specific requests should be directed. In exercising this authority for visits to CH-administered facilities, ID shall obtain prior concurrence for each visit from the responsible site representative of the AEC (or the contractor, where there is no local AEC office).* E.
