SUBJECT: Proposed Reply to Letter from Officers
of Inter-American Bar Association
1. This memorandum suggests action on the part of the DC;I.
Such requested action is contained in paragraph 4.
2. There is attached a letter from Messrs. Valiance and Norbert;,
respectively Secretary-General and Treasurer, of the Inter-American
Bar Association requesting a decision on their request for Agency
support to an Inter-American Committee for the Juridical Defense of
Western Democracy.
4. It is requested that the Director sign the attached repl to
Messrs. Valiance and Norberg, if he concurs.

RESOLUTION 10 Regarding
INTER-AMERICAN COMLIITTEE FOR JURIDICAL DEFENSE OF WESTERN DEMOCRACY
Adopted at Tenth Conference Inter-American Bar Association
Buenos Aires - November 14-24, 1957
1. The Chaotic situation of the world, confronted by upheavals
of all kinds aggravated by new scientific discoveries, justifies the
supposition that men have no other hope but the law, which is, above
all, the establishment of order for the preservation of peace;
2. At the present moment jurists of America have a noble mission
to accomplish, since by the science they profess, they establish the
norms which must govern human relations;
3. Furthermore, it is a primary duty to promote and maintain
solidarity among all American countries, as a particular consequence of
common rqcial, cultural, economic and continental factors that contri-
bute to make all the Americas - which is a new Hemisphere, replete with
possibilities, uncontaminated by long wars - a unit struggling for the
preservation of world peace.
A. That Western Democracy is based on the rule of Law, -hich by
means of the free and separate evolution of the three classic
powers - Executive, Legislative and Judicial - within a coor-
dinated sphere and one of mutual respect, ensures in a juri-
6ical system, all the inalienable rights of man and his per-
fection in the material, moral, spiritual and intellectual
fields;
B. That the Judicial Poorer by its specific functions directl7T
protects Human Rights and, therefore, it is necessary to en-
sure that it is constituted and preserved with complete in-
dependence;
C. That in every American country there should be a Bar Associa-
tion which must combat, if necessary, despotic regimes wh'Lcii
ignore the existence of juridical order;
D. That Committees for the Juridical Defense of Western Demo-
cracy be created in all countries of America as soon as
possible, comprised of judges and lawyers, thus continuin
the work which has been begun so successfully, so that fi-
nally, these will be grouped into an organization for the
purpose of exchanging; opinions and unifying procedure which
may be necessary for its greater efficiency;
E. That an Inter-American Committee for the Juridical Defense of
Western Democracy be created, whose members shall be desig-
nated by the Assembly in the next Plenary Session on a pro-
posal of the Executive Committee;
F. That by means of the self-determination of peoples, all dic-
tatorships as systems of government be repudiated ant abol
i shed, whatever their principles or purposes, and to urge he
people of the Americas to struggle for the rule of Peace,
Liberty, Justice and Law which constitute true Democracy; aid
G. Homage is rendered to all those who have fallen in the de-
fense of public freedom in the countries of America, and so-
lidarity is declared with all countries suffering the hard-
ships of dictatorship and with all nations and individuals
fighting presently for their freedom;
H. That the seat of this Committee be Buenos Aires;
I. That the Committee be provisional;
J. That the Committee be composed of the following members:
a) Members ex oficio who are the charimen of the Committees
for the Juridical Defense of Western Democracy, formed
or to be formed in each country, or their representatives;
b) The individual names will be considered subsequently by
the new Executive Committee.
