Plan for George Mason University
1. George Mason University has proposed that CIA
establish a liaison relationship to help its Educational
Planning Committee develop an educational plan responsive to
the needs of federal employees, particularly those residing
in Northern Virginia. We surmise that the purpose of the
liaison will be to discuss a 10-year projection of the
number of Agency employees and possibly their children who
are potential users of George Mason University programs.
2. For your information, the attached letter nominates
an individual from the Office of Training should you wish to
establish this liaison relationship.

George Mason University is currently in the midst of creating a new
ten-year plan for this institution of higher education. A group
known as the Educational Planning Committee has been appointed to
draft a planning statement. As the regional University for Northern
Virginia, it is incumbent upon this institution to be aware of the
needs of those citizens working for federal agencies in or near North-
ern Virginia. Because your Department is one of the major federal ac-
tivities in the national capital area, the Educational Planning Com-
mittee would very much like to have a liaison with your Department to
discuss not only needs but also, potentially, changes. It would be
most helpful if I were able to have the insights of an appropriate in-
dividual within your Department as to the positive and negative impacts
of such changes. I am, therefore, requesting that you recommend the
name of an appropriate person within your Department who might serve
as a liaison in helping the Educational Planning Committee fully de-
velop the educational plan which will respond to the needs of federal
employees, particularly those who are residents of Northern Virginia.

In my letter to you of 21 October I promised further word on your
stipulation (in your letter to me of 7 July) regarding your "right of
authorship over and right to ublish" your writings while in scholar-
in-residence status with us. I Itells me that when you talked at STAT
the Council on Foreign Relations meeting here in Washington on 22
November you indicated some disposition to soften that condition. Never-
theless, as I promised to tell you what is possible, here it is.
As I mentioned in my letter, the problem is a Government-wide one,
not peculiar to the CIA. It is created by legislation and subsequent
regulations designed to protect the taxpayer and the general public, the
one from dual compensation, the other from privileged and selective
release of information which is in the public domain. The general rule
is that the Government may not copyright its written products, which
belong to the people. Associated with this is a rule that employees of
the Government may not sell anything they have produced in the course of
their work for the Government (which, in principle, belongs to the people
also). It now appears, however, that a new amendment to the US Code (17
U.S.C. 105), in the light of its legislative history, does enable Government
contractors to copyright and thereby protect works they have prepared in the
course of discharging their contract obligations to the Government, provided
the denial of copyright protection is deemed "unfair or would hamper the
production and publication of important works," which is an administrative
decision. Consequently, you might, with administrative approval, copyright
a paper or report you had prepared for the Agency, thereby protecting your
contributions to the effort from infringement.
Unfortunately, a similar concession has not been extended on the issue
of compensation. You could not, therefore, sell the paper you had copy-
righted, or receive an honorarium for its publication. At the same time,
there appears to be nothing to prevent you from preparing, on your own time,
a work of your own creation that could be copyrighted and published with
remuneration, even though that work reflected what you had learned and
drew upon unclassified materials you had located while in Government service
(so long as the latter are also available to other scholars). To be sure,

it would be preferable for all concerned if the final stage of this
process (that is, the "selling" of the book to a publisher) was
deferred until you had left the Government. This would seem to be
indicated by an Executive Order that enjoins Federal employees to
avoid any action that might result in or even create the appearance
of using public office for private gain.
In sum, if you should produce an unclassified version of a work
that you produced while here, that version could be copyrighted if you
deemed that desirable. The same could not be published for profit, but
its substance could be included, along with other materials, in works
produced on your own time, either while in residence or afterwards, which
works could be copyrighted and sold -- though preferably after your
return to academia in order to avoid even the suggestion of an impropriety.
I trust this clarifies a vexing and somewhat confused subject. It
gives you assurance that not all the work you do for us will have to be
simply left behind when you depart. I hope it will also persuade you to
proceed with the plan to come here for a year. If it does, please
let me know as it is desirable to start the paperwork (including the
security clearance) early in the coming year. Perhaps I should warn you
that the latter will call for some visits to your neighbors and colleagues
and for a polygraph test, which is the final step in the clearance process.
I am aware that some academics find these requirements repellant but I am
