C. 20515 Dear Mr. Chairman: This is in response to your request for our views on H.R. 6881, a private bill to restore Mrs. Olson's survivorship pension under the Federal Employees' Compensation Act. On 17 July 1975, the Olson family filed a wrongful death claim with the Central Intelligence Agency under the Federal Tort Claims Act for money damages. However, a suit under the Act would undoubtedly have failed as the courts have consistently held that the Federal Employees" Compensation Act provides the exclusive remedy for death resulting from work-related injury. The White House and the Agency, in consultation with the Olson family attorney, agreed to support a private bill. The private bill provided $1.25 million compensation to the surviving members of the immediate family of Dr. Olson and terminated Mrs. Olson's pension of $800. 00 a month. When the bill, S. 3035, was passed last year, however,, the amount of the compensation was reduced by the Congress to $7.30,.000 and the pension terminated. This Agency has supported fair and equitable compensation to the Olson family, and we have no objection to H. R. 6881. The Office of Management and Budget has advised there is no objection to the submission of this report from the standpoint of the Administration's program. The White House and the Agency, in consultation with the Olson family attorney, agreed to support a private bill. The private bill provided a $1.25 million compensation to the surviving members of the immediate family of Dr. Olson and terminated Mrs. Olson's pension of $800. 00 a month. When the private bill, S. 3035, was passed last year, however, the amount of the compensation was reduced by the Congress to $750, 000 and Mrs. Olson's pension was terminated. The congressional sponsors of H. R. 6881 feel that the amount cut in the compensation requested was too drastic and that it was inequitable to terminate the pension. 3. Staff Position: Some difference of opinion has always existed within tency on the equities of supporting a private bill for the Dion family in the face of a long history of treating per- formance-of-duty employee death cases exclusively under FECA. However, there have been no changes in the circumstances which justified previous Executive Branch support for a private bill. Thus, it seems that we should continue to support fair and equitable compen- sation to the Olson family by indicating we have no objection to a bill to restore Mrs. Olson's survivorship pension.
