SUBJECT Status of National Security Council Intelligence
Directives (NSCIDs)
1. Reference is your question as to the status of the
NSCIDs, and whether they have been provided to the Senate
Select Committee on Intelligence.
2. The latest set of published NSCIDs, issu ~,ehrt ary
1972, has been provided to the SSCI by the NSC Staff. A precedent
had been set when the NSCIDs were provided to Senator Church's
investigating committee.
3. Executive Order 11905, issued in February 1976, required
that all NSCIDs be updated to conform with the provision of the
Order within 90 days. The Committee on Foreign Intelligence sent
a revised set of. NSCIDs to the Assistant to the President for
National Security Affairs on 19 May 1976.
4. At that time, however, a Freedom of Information Act
request for declassification and release of all NSCIDs was in
court on appeal, so the NSC Staff deferred action on the revised
NSCIDs pending outcome of the appeal.
5. As a result of the court action, the then-existing
NSCIDs Nos. 1, 2, 3, S, and portions of 6 and 8 were declassified.
The NSC Staff then returned the revised NSCIDs to the CFI and
requested further review in the light of the FOIA action.

6. On 8 September 1976 the CFI again submitted the
updated NSCIDs to the NSC with a request they be approved
and promulgated.
7. The NSC has not yet acted.
8. As a result, the 1972 NSCI have not been
