SUBJECT: Questions from Admiral Turner
The following is in response to your memorandum of 5 March 1977
containing questions from Admiral Turner:
2. The Attorney General's procedures relating to
electronic surveillance state that requests for elec-
tronic surveillance directed against U.S. persons abroad
"shall be made by the DCI, or Deputy DCI if the DCI delegates
this authority to him." Subsequent to the effective date
of these procedures, on 22 July 1976, the DCI made a general
delegation of authority to the DDCI. That delegation did not
make mention of the Attorney General's procedures on requests
for electronic surveillance; but it did give to the DDCI all
those authorities of the DCI as head of CIA. Since it is
the General Counsel's opinion that the DCI's authority to
make requests for electronic surveillance of U.S. persons
abroad is exercised in his role as head of CIA, the dele-
gation of 22 July 1976 is broad enough to give this
