I believe that your view concerning your priority attentions are
well considered and on the mark.
In addition, however, to looking to the SecState, SecDef and
NSC Advisor, you should add to them, I believe, the Attorney General
and the Department of Justice. To me the most striking thing about
the current and likely future state of American intelligence is the
increasing impact of legal issues and findings concerning intelligence
activities. This has taken DCIs more and more into the field of
carrying out dialogue and negotiations with the Attorney General and
there are a number of crunch issues and Catch 22s in this whole field.
It is vitally important that you become aware of some of these issues,
and I have asked General Counsel Tony Lapham to schedule some time for
discussions of these matters with you looking ahead to a series of
meetings between top CIA officials and top Justice officials so that
a process of mutual education and understanding can take place.

SUBJECT: Priority Problems and Issues
for Admiral Turner's Immediate
Attention
1. Admiral Turner wishes a prioritized list developed of
problems and issues which will require his immediate attention
after his return from Europe the night of 2 March. This memo
is a request that each addressee prepare such a list of priority
problems and issues, each item accompanied by a short descriptive
paragraph, and deliver the list to the O/DCI by 1200 hours,
Tuesday, 1 March. This office in consultation with ADCI will
develop a master list for Admiral Turner's information, to be
delivered to him the evening of 2 March.
2. To assist the development of these lists, Admiral Turner
has cabled his views on the overall priority of effort concerning,
"people to see and meetings to have," as follows:
a. Preparation for twice weekly meeting with President.
b. Preparation for NSC meetings.
c. Preparation for PRC/SCC meetings.
d. Congressional relations.
e._ Relations with.NSC. Advisoro, Secretary. of Defense,
Secretary of State, Attorney General/Justice Department.

PRIORITY PROBLEMS AND ISSUES
Congressional Relations:
A. Budget Hearings
.Although some budget hearings have already been held,
,twine, additional budget hearings are scheduled between 8 March
and 28 March, relating to the budgets of the NFIP, IC, CIA,
intelligence-related programs. Recommendations on Admiral
Turner's attendance at these sessions is made on the attached
listing.'
B. Proposed Covert Action an
nternational Agree menj'Briefings
These briefings would be separate and preliminary to the
proposed introductory briefings covered in (C) below. The covert r
action and international agreemen secsession should be
held with Chairman Clement Zabl , Ho International
Relations Committee. Former Chairman' Thomas Morgan dispensed
with Hughes-Ryan briefings because of leakage of information from
the Subcommittee securing these briefings. This situation should
be rectified with Zablocki, and he should be updated on current
covert action programs. The session with Zablocki will be
important in establishing a modus operandi with this particular Hughes-Ryan
committee. The session also would be a good forum for compliance
with the Case Act by reporting on certain agreements between the
CIA and foreign liaison services which the Department of State has
ruled are covered by the Case Act. Admiral Turner should also
meet with Chairman John Sparkman, Senate Foreign Relations
Committee, and Ranking Minority Member Senator Clifford Case
to report on the Case Act agreements and to review with them any
questions he or they may have on covert action briefings. These briefings
have not been scheduled pending clearance by the White House...,,
C. Proposed Introductory Briefings
There is a need for an introductory session between Admiral
Turner and committees other than the Senate Select Committee on
Intelligence and Appropriations Committees which share some oversight
responsibility, e.g., House Armed Services Subcommittee on Intelligence
and Military Application of Nuclear Energy, Senate Armed Services
Committee, Senate Foreign Relations Committee, and House International
Relations Committee. A worldwide wrap-up briefing of these Committees
would be a good way to initiate the relationships and is generally expected
by the Committees.

Attached is a listing of substantive intelligence brie ngs which
we are working on to comply with Admiral Turner's re est. List A covers
our major committees. List B reflects aj, e?subjects n which we are prepared
to brief committees with which we normally have-Ii e contact.
It is anticipated that Admiral Turner would not necessarily become
involved in the List B briefings but rather that they would be delivered
by teams of experts, however, he might want to introduce the briefers
or actually participate in some of the briefings. We will be , rm~
up dates for these briefings over the next two weeks.

E. Freshmen Breakfast
Twelve Freshmen Democrats from the House of Representatives
will break bread at CIA Headquarters on 8 March. All Freshmen
Members of the House have been invited to these sessions which
will be run for groups of twelve on every Tuesday, the 15th,
22nd, and 29th of March, as long as interest is sustained. There
are 47 Freshmen Democrats. We are working on the Freshmen
Republicans but they are not organized for such sessions as
of this time. We are contacting Freshmen Senators, one by one,
on a target of opportunity basis.

G. Meeting with Speaker
It is important to schedule an early session with the Speaker
in an attempt to iron out oversight problems in the House, e. g. ,
Select Committee with more or less exclusive jurisdiction and with
effective procedures against disclosures. Related to this issue would
be guidance for dealing with ongoing inquiries by other committees,
such as the House Select Committee on Assassinations (if it gets off
the ground) and the inquiries into the KCIA by both the House Committee
on Standards of Official Conduct and the House International Relations
Committee.
H. Review Confirmation Transcript Before it is Sent Back to the
Senate Select Committee on Intelligence
Admiral Turner should review the confirmation transcript
before it is sent back to the Senate Select Committee on Intelligence.
For Admiral Turner's information, a status report on follow-up actions
will be attached to the transcript.

The DCI's input to this PRM should be discussed with
Admiral Turner as a matter of first priority. Formation of a
task force under DCI sponsorship, briefing /tasking of NFIB and
PRC, and the role of the IC Staff in the review should be included
as topics. The DCI does not have the responsibility for drafting the
entire PRM; section 1 is to be under the direction of the Attorney
General and section 3 is the responsibility of the Special Coordination
Committee. However, the DCI should develop a comprehensive plan
and detailed terms of reference tying together the entire PRM. This
could be offered at the first opportunity in an attempt to bring focus
and expertise to the exercise.
PRM-11-related Topics
There are several outstanding issues which probably will be
encompassed by PRM-11 but which may require action or at least
more immediate attention by the DCI. These include a decision on
the form and substance of the NRO charter, legislation on the
protection of sources and methods, legislation to establish the
position of the second Deputy to the DCI (D/DCI/IC), and a legislative
charter for the IC Staff. In addition, the DCI should be kept informed
about the organizational review currently under way in the Office of
the Secretary of Defense.

for the HAC on 9 and 10 March, and an NFIP budget overview is
scheduled with the Senate Appropriations Committee on 16 March.
In addition to receiving briefings on the NFIP and ICS budget,
Admiral Turner may wish to attend some or all of the hearings.
PRM-10 - Military Force Posture
NFIP Budget Hearings
At present, Admiral Turner is listed as a witness for only
one Congressional budget hearing: the intel-related briefing of
the SSCI on 16-17 March. However, NFIP hearings are scheduled
several activities under way in this area. An even more fundamental
issue is the future of national estimates and the process through which
they will be developed.
This PRM requests an overall review of U. S. military force
posture as well as a net assessment. The DCI's role in this PRM
is unclear, but the intelligence input to the net assessment clearly
is of significance.
Review of Analysis on Soviet Strategic Objectives
One of the most important substantive problems is an
assessment of ways to improve in-depth analysis on Soviet
strategic objectives. The IC Staff together with the NIOs have

PRM on U. S. National Space Policy
A PRM is about to be issued requesting a review of U. S.
space policy. Under direction of the NSC, the IC Staff, elements
of the DoD, NASA, several civil agencies and the State Department
have been working to develop a terms of reference. This review
will address U. S. military, intelligence, and civil space programs,
and it will have major implications for U. S. intelligence collection.

SUBJECT . Priority Problems and Issues for Admiral Turner's
Attention
1. I have three large problems that the new DCI will need
to grapple with early. They are:
-- PRM 10. As I mentioned at this morning's
meeting, this is a very complex requirement indeed.
The intelligence input will be made in many ways
at many levels and it will be difficult to prevent
duplication and overlap. In comprehensive net assess-
ment, we will also be breaking new ground. The dead-
lines are short. A way must be found to mobilize in-
telligence resources in an orderly way if the best
use is to be made of them and if PRM 10 is not to
bring all other intelligence analysis to a virtual
halt. Given the importance of this issue, I believe
Admiral Turner may wish to take a personal hand
early in the process.
-- NIE 4-1-77. This is the major estimate on
warning of war in Europe. It is a paper that needs
to be done thoroughly and will require time. It
is also an important input to certain aspects of
PRM 10 and we expect to be under great pressure to
advance the deadlines on this estimate, which we
presently are hoping to complete in May. If we are
to do this job properly, and it needs to be done
properly, we will need the DCI's support in resisting
these pressures.

-- Manpower. The tasks set by the new admin-
istration are stretching the resources of the National
Intelligence staff to the limit. Of our 11 senior
positions, one is new and not yet filled, one is
vacant, and at least three more will become vacant
through retirement or completion of tour by the end
of the summer. I have felt that I could not recruit
officers who would be the DCI's personal represen-
tatives without his agreement and without being able
to give them some sort of assurance that the jobs
will continue at more or less their present level
of importance. Moreover, I need the DCI's active
backing in order to get quality people from State
and Defense. I realize that the answers I need
prejudge decisions that will be made under PRM 11
several months from now, but the demands of such
papers as PRM 10 won't wait.
2. Admiral Turner has also asked for .'. .f' on what we

The 1974 amendments to the Freedom of Information
Act were such that the Agency for the first time became
involved in any significant manner with Freedom of Infor-
mation requests from the public. This fact, coupled with
the sensational allegations and revelations concerning the
Agency which were made in 1975 and 1976, has resulted in a
situation where at the present time the equivalent of
approximately-100 ful1-time employees is devoted to the

Boyce/Lee Case
?
In mid-January 1977 Andrew Daulton Lee and Christopher
John Boyce were arrested by the FBI on charges related to
espionage on behalf of the Soviet Union. In substance,
Boyce and Lee provided the Soviets with highly classified
CIA information from TRW, Inc., Boyce's employer, for almost
1 1/2 years. At issue is the fact that the information
passed to the Soviets directly concerns highly classified
Agency relationships with foreign governments the public
disclosure of which could seriously affect these foreign
governments and U. S. Government technical intelligence
collection efforts. Boyce and Lee have been indicted
by a Grand Jury and trial is tentatively scheduled to
commence on 22 March 1977.

Edwin Gibbons Moore Case
On 22 December 1976 Mr. Edwin G. Moore II, a retired
Agency employee, was arrested by the Federal Bureau of
Investigation on espionage and other related charges.
He allegedly attempted to deliver classified CIA documents
to Soviet officials. Following his arrest a large number
of classified CIA documents were recovered from Mr. Moore's
residence. On 18 February 1977 Mr. Moore was indicted
by the Federal Grand Jury. All counts in the indictment
relate to the documents _recovered.
Agency representatives have had extensive meetings with
representatives from the U. S. Attorney's office and the
Department of Justice with regard to the manner in which
the four documents may be introduced into evidence. At
issue is the potential for public disclosure of the infor-
mation within the documents through their introduction
as evidence in court. This is aggravated by the requirement
that documents so introduced must be accompanied by
expert testimony as to precisely why the information is
damaging to the national security. The Agency is cooperating
with the U. S. Attorney's Office and the Department of
Justice to determine the extent to which such expert
testimony would be required to obtain Mr. Moore's conviction.
We are attempting also to prevent the public disclosure
of information of such significance to cause irreparable
damage to the national security. Mr. Moore's trial has
been tentatively set for 22 March 1977.

Disclosures by FBI

The Agency faces an impasse in the investigation by
the FBI of unauthorized disclosure of classified or
sensitive intelligence information. oThe Justice Department
will not permit an FBI inquiry into a "leak" unless the
material involved can be d Gsfied before an investigation
is initiated. In effect, there is no investigation unless
there is the probability of prosecution. The Agency
position regarding investigation of "leaks" is that the
unlikelihood of prosecution should not deter investigation.
Determination of the urce_of_a "leakk' ould permit
remedial or administrative act directed against the
responsible individual. Further, establishing how or
by whom information was compromised would permit establishment
of more effective protective mechanisms to prevent serious
'leaks" in the future.

expanded to include a prohibition against the use of
"black arts" outside the rigid perimeters of the Agency's
duly authorized activities. This precaution, in the mind
of the Office of Security, would be ill-advised. "Black
Arts" even in their widest connotation would not apply
to the majority of our employees. Secondly, even as a
suggestion it carries the inference that the Agency is
concerned that the individual may be considering embarking
on a criminal career. Finally, the essence of the Termination
Secrecy Agreement is the willingness on the part of the
employee to obey the law. Those employees, if any, who
might be harboring an evil intent would not be the least
bit deterred by such an admonition.

PROPOSED EXECUTIVE ORDER TO REPLACE EO 10450

In 1976 the Office of Management and Budget (OMB),
acting as the agent for the Domestic Council, coordinated
a proposed Executive Order entitled "Suitability Requirements
for Government Employment" which was intended to supercede
Executive Order 10450 of 1953 titled "Security Requirements
for Government Employment." The Agency and the Security
Committee of the Intelligence Community Staff took strong
exception to the proposal as inadequate to protect classified
informat_i_Qn_a d sensitive intelligence .information. The
Agency also viewed the proposal as a possible abrogation or
diminishment of the DCI's authority and responsibility
relating to the Government's National Foreign Intelligence
Program. OMB, in response to objections, initiated action
to accomplish a rewrite; however, no action was taken on the
matter prior to the change of administrations, Since the
Carter Administration, the proposal has been referred back
to the Interagency Advisory Group which is chaired by the
Civil Service Commission. A meeting is set for the last
week in March. CIA will be invited to participate; however,
it is believed that the group will recommend the adoption of
standards that still will not meet our criteria.

arrival at Headquarters. I am looking forward to an early
opportunity to spend some time with Admiral Turner describing
to him DD/S&T functions, programs, and the resources we are
charged with managing. I am particularly anxious for him to
understand that we are char ed with managing substantial

Turner will also be anxious to gain some overall understanding
of the DD/S?T and will be taking the initiative to schedule
a meeting with me for this purpose as soon as his time permits.

I will be having a meeting of the S&T Advisory Board and
suggested that Admiral Turner might want to take that
opportunity to meet this panel since they are a resource he

to know the individual panel members in an informal environment.

1 . The President has reaffirmed to me briefly the report we raDi~
in the press that he wants me at an early date to make a presentation
to the Cabinet on the capabilities of the Intelligence Community and
what support we may provide to the Cabinet. I would like to be
prepared to do that as soon as possible.
2. I have in mind a maximum of ten minutes. I believe we must
do this without viewgraphs or such visual aids, although a one or
two page handout might be very helpful. I think we could distribute
that around the table.
3. I would like particularly to point out the kinds of support
we might provide to officers other than State, Defense, and Treasury,
who are our regular customers. In this connection, I would like to
propose a formalized liaison system between us and each Cabinet officer.
I would envision this system being such that there would be just enough
interchange that we would always be sure we knew the primary activities
and concerns of these Cabinet officers. We could search our data bank
to see if we have materials useful to this particular concern. I told
the President that I intended to volunteer support to the Cabinet in
this way rather than just expect them to call on us. I'm not clear
in my mind as to whether the best point of contact for Cabinet officers'
staffs should be in the IC Staff or the Agency staff.
4. Please work together in putting a presentation together.

Comptroller, and OEEO.

1. The Executive Secretariat is an integral part of the DCI's command
and control system. It has a special responsibility to see that the

DCI requirement, whether it is generated by the DCI himself or in
