SUBJECT: Title I of the SSCI Draft Legislation
1. Reference is the set of papers on Title I of the SSCI draft
legislation provided you prior to your departure (DCI/IC-78-0605) and
its attachment.
2. The attached page 3 should replace the present page'in the paper
titled, "Intelligence Community Comments on the 18 January 1978 Version
of Title I..'.."
3. The only change is the insertion of the fifth paragraph beginning
"The Department of State believes that (j) (1) (B)...."
4. State legal officers nude quite an issue on this paragraph.
They concede that paragraph 1-601 (g) in E.O. 12036 gives the DCI
responsibility for agreements with foreign intelligence and security
services, but they also stress that the E.O. at paragraph 1-904 makes
the Secretary of State responsible to "coordinate with the DCI to ensure
that national foreign intelligence activities are useful to and consistent
with United States foreign policy." Since there is no mention of Secretary
of State responsibilities in the draft Title I, State officials put con-
siderable importance in the statement which has been added to page 3,
despite the counterargument that you would normally do such consulting
anyway.
