MEMORANDUM FOR THE DIRECTOR
SUBJECT: Suggested Request for Material to be Levied on Mr. Beal
1. Per our brief conversation on 26 August, my colleagues and I
believe it would be helpful if you could ask Mr. Beal to furnish us with copies
of any depositions or sworn statements made by any of the defendants in the
Green Beret case, any depositions or statements made by other military
personnel not accused but having knowledge or alleged knowledge of matters
relating to this case, and any investigative reports or transcripts of the
Army's investigation available at this time.

2. If Beal asks, we are perfectly justified in making such a reque st in
light of the press comment that has appeared to date and the other clear indica-
tions that if this matter does go to trial, at least a part of the defense that the
accused intend to offer is the claim that the actions for which they are charged
were at least tacitly condoned by some Agency officers. It could be pointed
out to Beal that we would like an opportunity to review the available record
in detail so that we can compare the reports we have received through our own
internal channels with those developed by the Army during the course of its
investigation.
3. As you are aware, we already have in hand from the Station some of
the material described above, including sworn depositions by five of the eight
military personnel who were detained. (We have no depositions from Colonel
Rheault, Major Middleton, or Major Crewe since all three of them have
refused to testify under the 5th Amendment.) There are two reasons for asking
Beal to provide material, parts of which we already have. One (a trivial one)
is that we may get more legible copies since the documents now in our possession
are extremely difficult to read. The other point, an important one, is that the
material we now have was given to us more or less unofficially by the Army in
Saigon and, hence, we in Washington are not quite sure how far we can go in
mentioning details gleaned from these documents in discussion with senior
military officials here. If the Pentagon provides a full record, there will be
no inhibitions on future conversations.
