1. Pursuant to your request, Mr. Lowther of the Justice
Department phoned on the afternoon of Friday, 22 August. I
invited him to come over and have a chat respecting the requests
which he had made on of the office of our General
Counsel.
2. Lowther inquired whether I planned to discuss ways and
means of responding to his request or the question of policy as to
whether or not we would respond. I told him that it would be the
latter. He also inquired whether or not I planned to discuss the
point which you had earlier raised as to dropping count one of
the indictment. I said that I did plan to discuss this point.
3. Lowther then requested an opportunity to have a talk
with his superiors and later phoned back and stated that in the
absence of Mr. Murray (the new Chief of Criminal Division) he did
not feel qualified to discuss these questions. He stated that the
Department of Justice would get in touch with me some time early
next week in order to pursue this discussion. I stated that we
would be glad to talk with than at any time and suggested that they
first try to get in touch with you. I further suggested that
Lowther brief Mr. Murray on the facts and background of this case,
since Murray did not seem to be familiar with them when you talked
to him, and Lowther indicated that he would do so. Accordingly,
the next move is up to the Department of Justice.

tomorrow or at the latest early next week as he had to prepare his
case
