Monday - 12 September 1977
24. (Unclassified - JEC) FOIA Called Rob Lyon, Minority Counsel,
Senate Judiciary Subcommittee on Administrative Practice and Procedure,
and asked if he could give me any information. on the hearings which the
Committee has scheduled for Friday, 16 September, on the (b)(l) exemption
to the FOIA. He said he had just received the paperwork and would get
back in touch with me after he had been able to go through it.
25, (Unclassified - JEC) LEGISLATION Received a call :From
Nanette Blandin, OMB, concerning our proposed language for financial
disclosure legislation. She said she had no problems with the language and
that Phoebe Felk, also of OMB, would be getting in touch with us either
this evening or early Tuesday morning to give us the final clearance to go
up to the Hill.
26. (Unclassified - J.EC) LEGISLATION Called Bob Ca:rlstrom, OMB,
to give our views. on a draft Department of Justice bill which would extend the
coverage of the Federal Tort Claims Act. I told him that in general we had
no objection to the bill, but raised several problems including increased
litigation, paying damage judgments and defining who is an employee. He
said he would be back in touch if they needed anything else, and that it was
not necessary to send a letter.
27. (Unclassified - YTF) LEGISLATION Talked to Brian Walsh, on
the staff of the Senate Governmental Affairs Subcommittee on Federal
Spending Practices and Open Government, who had asked to be notified when
we sent our views letter on S. 1264, the Federal Acquisition Act of 1977,
to the Committee. He mentioned that the Subcommittee had taken care
of our concern regarding single-source procurement contracts. He would
appreciate it if someone would call him within the next week or so and explain
our problems regarding protest procedures for classified contracts.
28. (Unclassified - RLB) LIAISON Elliot Maxwell, on the staff of
the Senate Select Committee on Intelligence, called and requested a copy of
the latest Agency regulation or other paper dealing with relationships with
newsmen. I passed this information o follow up.

19. (Unclassified - RLB) LEGISLATION Spoke with Elliot
Maxwell, on the staff of the Senate Select Committee on Intelligence, and
informed him that I would not be able to provide him a copy of the
3 September memorandum from the Director to Dr.. Brzezinski, Assistant
to the President for National Security Affairs, on charter legislation.
Mr. Maxwell said he might be able to come out tomorrow to discuss in
general terms intelligence charter legislation.
20. (Unclassified - JEC) LEGISLATION Received a call from
Alan Coffey, Minority Counsel, House Judiciary Subcommittee on
Administrative Law and Government Relations. He told me that hearings
are scheduled on financial disclosure legislation for Friday, 9 September,
and Monday, 12 September, and that the bill would probably be marked
up the week of 12 September. He said that the full Committee was committed
to reporting the bill by 22 September. I thanked him for the inforrrmation,
and told him we had some comments at OMB and as soon as we received
clearance we would be down to talk to him and the Subcommittee's Majority
Counsel, Bill Shattuck. He asked a number of questions concerning areas
which we had previously discussed, and I refreshed his memory about
the problems.
21. (Unclassified - SKM) LEGISLATION,,, Received a call from
Bob Carlstrom's Secretary, OMB, who said they needed verbal comments
on a Department of Justice draft bill they had forwarded to us that would
amend the Federal Tort Claims Act by Monday, 12 September. Their STAT
original deadline was 16 September.
