SUBJECT : FOIA Request on Behalf of Mr. Philip Agee
1. Attached is a copy of an FOIA request presented on behalf of
Philip Agee by an attorney, Melvin L. Wulf. The request, dated
9 November 1977, went simultaneously to the CIA, NSA, FBI, and the
Departments of Defense, State, and Justice. Although submitted under
FOIA, the request is a typical "my file" request for "access to and
copies of all files and records of every description... that pertain
to, refer to, or in any way relate to Mr. Philip Agee."
2. Initially, the plan was to have all identified documents
reviewed by the DDO. It quickly became apparent, however, that the
workload would be too large for this approach and it was agreed that
each component would review its own findings, referring to the DDO
those documents involving DDO equities.
3. In December we wrote to the other recipients of the Agee request
requesting their cooperation in ensuring that all documents, classified
or unclassified, originated by this Agency or containing information
obtained from this Agency are referred to us for our coordination and
review. We recently received four referrals from the FBI, two of them
concerning Bureau documents and two covering CIA documents found in FBI
files. Processing of these referred documents and review of documents
found in CIA files is continuing with the principal burden falling on
the DDO and the Office of Security. Nothing has, as yet, been released

This is a request, seperately directed to each of the agencies
described above, under the Freedom of Information Act as amended,
on behalf of Mr. Philip Agee.
On Mr. Agee's behalf, I r est access to and copies of all
files and records of every description, including all written doc-
uments, sound recordings of any kind, and photographic material,
in the possession of each of the agencies described above, that
pertain to, refer to, or in any way relate to Mr. Philip Agee.
I enclose a copy of a letter, and a Certificate of Acknowledg-
ment of Execution, authorizing this request on Mr. Agee's behalf.
The letter also describes Mr. Agee's history of employment with the
United States, and lists the addresses at which he has lived in re-
cent years. I retain the original copy of the letter and Certifi-
cate of Acknowledgment in my office.
I believe that this request comes within the terms of the Act
which allows the fees to be reduced or waived if that "is in the
public interest ..."%,afld^therefore ask that the fees be waived.

such information. I was born on January 19, 1935 at Tacoma
Park, Maryland. I was employed by the Central Intelligence
Agency from August or July 1957 until January 1969 with the
period August 1957 to June 1960 (approximately) on active
duty in the U/8 Air Force. I was also employed by the Department
of State from November 1960 until January 1969 under a cover
arrangement with the Central Intelligence Agency.

This was our scknow Iedgeno-at letter. We had first
typed a letter to Wulf stating our intention to
process the request under the Privacy Act, but this
was never sent. objected to giving.
Wulf something to o ,sect to. Ernie's opinion was
that if the request specified the Freedom of Inform-
ation Act, it should be so processed. In other
words, we switched from PA to FOIA at our own
volition, and not, as I told you earlier, at the
insistence of the requester. (We have in our
file a copy of Justice's acknowledgement letter
to Wulf which indicates that Justice will process
it as a Privacy Act request, however.)
