SUBJECT: Order No. 12036 Im act on
1. On I February 1978 the Office of General Counsel (OGC)
notified the Office of Training (OTR) that OGC has withdrawn
its concurrence in the proposed revision of STATINTL
The reason cited is that t e new
domestic organizations by employees of agencies within the
Intelligence Community-in this case attendance by CIA
employees in academic institutions under cover without
advising "appropriate officials" of their CIA affiliation.
Attached are copies of the memorandum from OGC and extracts
from the Executive Order which OGC reports as pertinent.
2. OTR recognizes that the OGC interpretation could
seriously restrict or impair the Agency's ability to secure
external training for personnel under cover. Accordingly,
we plan to request clarification from the OGC on the following
points:
Executive Order 12036 prohibits undisclosed participation in
a. Is training of a student at an academic
institution a "contract or arrangement for the
provision of goods or services?"
b. Is the Agency planning to request the
Attorney General to exempt training from these
restrictions for individuals under cover?
