REFERENCE: Memoranda n for Director of Personnel from OGC, dated
7 November 1977, Subject: Training for Re-employment

1. During our discussion of 3r.-request, you opined that
the request should not be honored because of restrictions imposed by
Title 5 of the U. S. Code. The Agency's authorities for waiving certain
provisions of Title 5 are quite explicit and appear to support an opinion
that external training can be provided only for improving an employee's
skills, knowledge and abilities for performance of "official duties."
Nevertheless, paragraph 4 of the reference could be interpreted that the
DCI may authorize the training requested by Mr. even though it is
for future employment and not for official duties.
2. In view of the confusion noted above, it is requested that an
opinion be rendered relative to the DCI's authority in this particular
case.
