Approved For Release 2005/03/24: CIA-RDP81-00818R000100020023-7 21 May 1968 MEMORANDUM FOR THE RECORD SUBJECT: S. 1035 - The Ervin Bill 1. Met with Mr. Bun Bray, Manpower Subcommittee staff, House Post Office and Civil Service Committee. Mr. Bray advised that the Committee in all probability would be hearing the wage board pay increase bill, S. 2303, some time in June and might hear S. 1035, the invasion of rights bill, almost simultaneously. It had been agreed in the Committee that these two would be heard before H. R. 460, employee management relations bill. 2. He suggested that it would be well if we do some thinking "about a bill that we could live with", and secondly, if we do some thinking about a bill containing complete exemption for the Agency. He does not feel that the Committee will act on S. 1035, but that they will put out a bill from the Committee that insofar as possible does not deliberately offend the proponents of S. 1035. 3. I reminded Mr. Bray that we had attempted, as had Chairman Henderson, to have Colonel White, Mr. Henderson and possibly Mr. Gross meet on this subject and that such a meeting now appears to be strongly recommended at such time as scheduling for the hearings on the invasion of rights of Federal employees are scheduled by the Committee. Mr. Bray appeared to agree. 4. Mr. Bray noted, in closing the conversation, that it now appears that we will have summertime hearings on the S. 1035 propo- sition. As he has been in the past, Mr. Bray was informative as possible, and I expect he will keep us up to date as the matter progresses. I plan to stop by and see him frequently from here on out. Met with Mr. Charles Johnson, Chief Counsel and Staff Director, House Post Office and Civil Service Committee, who advised that he is getting some indication of pressure in the Henderson Manpower Subcommittee against exemption of CIA, NSA and the Bureau. He reiterated that the Chairman is still opposed personally to reporting a bill by the Committee, but appears to feel now that he may have to report a measure. Mr. Johnson does not feel that Mr. Henderson will report S. 1035 itself, but rather that he will report a new bill. 2. We reviewed our earlier discussions, as well as the discussion he and Mr. Bun Bray had with Colonel White when they visited Headquarters, and I reaffirmed that the Director would make himself available as a witness. In this regard Mr. Johnson indicated that at such time as the hearings are actually scheduled it might be well to sit down with Representative Henderson and possibly Representative Gross. 3. Mr. Johnson feels that sufficient pressure has been built up that Mr. Henderson will not be able to avoid hearings even though he will, in all probability, delay the start of hearings until at least mid-June and then continue the hearings for as long as his members desire any further hearing or review of the subject matter.
