ADMINISTRATIVE INTERNAL USE ONLY Approved For Release 2005/01/06 : CIA-RDP81 M00980R00020001.0050-41, OLC 78-0129 16 January 1978 MEMORANDUM FOR THE RECORD SUBJECT: Ms. Jean Fitz-Simon, Department of Justice, Request For Review of Senate Human Resources Subcommittee on Health and Scientific Research MKULTRA Files 1. Ms. Jean Fitz-Simon who works on FOIA matters with the Department of Justice, is currently handling an appeal case on behalf of the Drug Enforcement Agency (DEA). In an attempt to determine what files and involvement if any, DEA has on MKULTRA type related matters, Ms. Fitz-Simon requested permission from Mr. Walter Sheridan, of the Senate Human Resources Subcommittee on Health and Scientific Research staff, to review the Subcommittee's files on drugs. Since the Subcommittee's files contain classified CIA documents, Mr. Sheridan wanted us to determine if CIA had any problem with allowing her access to the Subcommittee's files. 2. I checked with of OTS (MKULTRA records) anc of ORD to see if they would have any objection to Ms. Fitz-Simon reviewing this classified CIA material. Neither one had an objection and according to Ms. Fitz-Simon has already reviewed, at his office, a the classified MKULTRA material held by OTS. I lof OLC, confirmed that Ms. Fitz-Simon's clearance with J is current and is at the Top-Secret level. 3. Before calling Mr. Sheridan, I called Ms. Fitz- imon an advised her that should she come across any DEA leads in the classified CIA material held by the Subcommittee that she should contact me before taking any further action. She agreed. 4. On 13 January 1978, I advised Mr. Sheridan that CIA had no a jection if Ms. Fitz-Simon reviewed the Subcommittee's drug files. Mr. Sheridan said he would contact her and set up an appointment.
