This is an appeal pursuant to subsection (a) (6) of the Freedom of
Information Act (5 U.S.C. 552).

This is a request under the Freedom of Information Act as amended (S U.S.C.
Section 552). .
On behalf of Common Ground, anon-profit, tax exempt newspaper of the
University of Cali o~ a manta Barbara (UCSB), we write to request a copy
of all files in the Central Intelligence Agency indexed or maintained
under the name Martin Luther Kirk, Jr.: and all documents returnable
by-a search for documents containing this name.-.This includes,-but is not
limited to, information in any "Do Not File" and "Administrative Matters"
files, and any other similarly labeled file(s) which contain information
relevant to our request. ?
As you know, the amended Act provides that if some parts of a file are
exempt from release that "reasonabley,segregable" portions shall be provided.
We therefore request that, if you determine that some pootions of the re-
quested information are exempt, you provide us immediately with a copy of
the remainder of the file. We, of course, reserve our right to appeal any
such decisions.
If you determine that some or all of the requested information is ex-
empt from release, we would appreciate your advising us?as to which exemp-
tion(s) you believe covers the information which you are not releasing.
We are prepared to pay costs specified_?in your regulations for locating
the requested files-and reproducing them. ~ ~ ?
As you know, the amended Act permits you to reduce or waive the fees if
that "is in the public interest because furnishing the information can be
considered as primarily benefitting the public." We believe that this re-
quest plainly fits that category. and ask that you waive any fees.
As provided nor in the amended Act, we will expect to receive a reply
within 10 working days.

This is in response to your letter of 5 October 1979
in which you appealed this Agency's failure to respond to
your Freedom of Information request for all files in the
CIA indexed or maintained under the name of the
Reverend Martin Luther King, Jr. Th1s FOIA request was
amended by correspondence from Common Ground, dated
28 October 1979, to include "al n armat on in CIA
files concerning the circumstances leading up to and
concerning Dr, King's assassination, as well as all
information pertaining to all investigations of Dr. Icing's
murder/assassination in CIA files."
We realize now that a search, in June 197b, has already
been made for all CIA documents retrievable under the names
of Martin Luther King and James Larl Ray in response to
another FOIA request. Since that search would have re-
trieved any and all documents retrievable in response to
your request, it would appear that doing the search again is
unlikely to produce additional documents. As a result
of our search on both personalities, a total of 373 docu-
ments (704 pages) were retrieved from CIA records. Copies
of the releasable versions of these documents are available
to you for 10~ per copy of each page, our standard copying
fee.
