OLC #782218 2 June 1978 MEMORANDUM FOR THE RECORD SUBJECT: Meeting with Jim Bush., House Permanent Select Committee on Intelligence Staff, re Title IV of H.R. 12240 1. On Friday, 2 June 1978, = 1. and I met with Jim Bush, House Permanent Select U0MJ11,LLLt;V V,11 elligence staff, and told him that we wanted to informally let him know that the Department of State was attempting to rush-'a formal letter to the Committee -objecting to Title IV of H.R. 12240 concerning excludable aliens. I told Bush. that, while we did not have a formal Administration position on Title IV at this time, we expected that the letters to the committees appealing the House Permanent Select Committee on Intelligence and Senate Select Committee on Intelligence budget authorization decisions would say that we believe Title IV to be unnecessary and that any dispute between the Department of State and the Department of Justice regarding the admittance of excludable aliens would be resolved in the context of the Special Coordination Committee overview of counterintelligence. 2. Bush understood that what I was giving him was informal and for the assistance ofChairman ion E oland in case he got any floor discuss for House action. 3. This meeting with Bush was based on a previous call that had from Tracy Cole, OMB, who had informed us that StateSTAT was as ing for clearance on their negative position, Tracy first asked us if we could provide an Administration position from the Dire for on this matter. After consultation with taff, and , Office of Program and Budget Development, I told Tracy that we could not provide a coordinated position on short notice and really hoped that we could orderatoept develop a response through the appeal this. It was on the basis of this set of events that I then went and spoke to Jim Bush. All of this was in expectation that H.R. 12240 would come up for vote on the floor of the House on 2 June. This did not happen.
