C. 20500 Dear Dave: As I indicated to you on the telephone this afternoon, Stan Turner and I are in substantial agreement with respect to the outstanding issues on the proposed intelligence charter legislation. I attach hereto the proposed language on the issue of the proposed Administration position involving reporting to Congress. While Stan indicated he did acquiesce-to DoD on this issue, I don't believe he has seen the attached language which is forwarded to him by copy of this letter. We both believe that the language in the bill is unacceptable and that the language in the Executive Order is not a viable alternative. The attached simple language should be a realistic base from which to negotiate this important issue, with the Senate Intelligence Committee. The heads of each entity of the intelligence community shall provide information about intelligence activities requested by the Permanent Select Committee on Intelligence of the House of Representatives and the Select Committee on Intelligence of the Senate that is necessary to the functions and within the jurisdiction of those Committees. This duty to report does not supercede or otherwise change any authority conferred on or duty required of on the executive branch by the Constitution or other provision of law with respect to protection of intelligence sources and methods or other aspects of-the national security.
