The "National Intelligence Reorganization and Reform
Act of 1978" (S. 2525), which was recently introduced in
the Senate, would establish a comprehensive statutory
framework for the conduct of intelligence activities
directed at United States persons or foreign persons with-
in the United States. The Select Committee on Intelligence
of the Senate, and, in particular, its Subcommittee on
Charters and Guidelines, will be considering over the
next several months the suitability of that framework.
It would be of assistance to the Select Committee if
the Central Intelligence Agency could review with Committee
staff members a representative sample of recent espionage
cases, including both those which were brought to trial-
and those which were not, to determine whether the Agency
would have conducted its operations in those cases dif-
ferently under the proposed statute than it did in fact.
The Subcommittee on Secrecy and Disclosure of the Select
Committee has already reviewed a number of such espionage
cases in a different context and this should facilitate
the process.
I am sending a similar request to Director Webster
of the FBI (copy enclosed), and hope that your staff will
coordinate with that agency in the review process,
I hope you will agree that such a review would
contribute to the ultimate utility of the charter legis-
lation. If you have any questions with respect to this
