BRIEFING Accompanied Tony Lapham General Counsel, an Assistant General Counsel, to a meeting with Mark Gitenstein, David Bushong, Tom Moore and Pat Norton, Senate Select Committee on Intelligence staff, to discuss the Director's scheduled 1 March appearance before the Subcommittee on Secrecy and Disclosure on the subject of use of classified information in criminal prosecutions. Mr. Lapham outlined the planned thrust of the Director's statement which would be to simply identify the problem and not suggest any remedies. Gitenstein indicated this was acceptable as the purpose for entire first day's testimony is simply to frame the issues and problems involved. Gitenstein gave us a draft memorandum which he planned to give to Senators to prepare them for the hearings. Included are hypothetical cases which-may be subject for discussion. Gitenstein emphasized both the memorandum and the hypotheticals were subject to change and invited our comments. Gitenstein did make a number of changes based on Mr. Lapham's remarks. Finally, Gitenstein gave us a list of other witnesses planned for the hearings. Bob Kuech, Criminal Division, Justice Department, also attended the meeting. 13.1 LIAISON Met with Abe Shulsky, Senate Select Committee on Intelligence staff, and showed him answers to questions asked at a recent substantive intelligence briefing on NIE 11-3/8. .14. LIAISON Met with Stan Taylor, Senate Select Committee on Intelligence staff, and reviewed with him meetings set up for 27 and 28 February regarding NFAC computer programs, particularly the SAFE System. Richard Beal, new consultant to the Committee, will participate in the meeting. 15.
