SUBJECT Civil Service Reform Act of 1978

1. Per our telephone conversation of 30 October,
please find attached copies of Sections 310 and 311 of the
Civil. Service Reform Act of 1978.
2. Section 310, entitled "Antidiscrimination policy;
minority recruitment program", amends section 7151 of Title S
of the United States Code (U.S.C.). I call your attention
to subparagraph (a)(2)(A) of section 310 which defines those
positions covered.. As CIA and NSA are exempt by virtue of
section 5102 (a) (1) (G) (vi) and (viii) from the provisions
contained in Chapter 51 of the U.S.C., it is the opinion of
this office that section 310, which amends Chapter 51, would.
have no effect on current CIA or NSA practices.
3. Section 311, entitled "Temporary Employment Limitation"
would,.on the other hand, be applicable to both CIA and NSA.
