Thank you for the opportunity to review the Office of Management and
Budget's draft bill to establish a Commission on Retirement Policy to
investigate and evaluate public and private retirement programs in the
United States.
While the Central Intelligence Agency has no objection to the substance
of the draft proposal, it should be noted that the extent to which this Agency
may provide data on funding and numbers of personnel will be restricted.
by its responsibilities to protect classified information relating to intelligence
sources and methods including, among other things, certain information
concerning the organization of the CIA and the functions, numbers and
salaries of its employees. Amending section 4(c)(2) of the draft bill to
read "[E]xcept as otherwise provided by law, the Commission.. . " would
clearly recognize the limitations appropriately imposed by law to protect
various categories of information from disclosure. Examples of such
laws include not only the National Security Act of 1947, as amended, and
the Central Intelligence Agency Act of 1949, as amended, but also the Privacy
Act and other statutes. We therefore recommend such an amendment.
