ATTENTION
FROM
1. Thank you for the copy of materials concerning recent amend-
ments to 5 U.S. C. 7342, Foreign Gifts and Decorations, which authorizes
Agency employees to accept gifts under the conditions specified in that
section. I presume you provided these materials in response to the
suggestion in paragraph 27 of my 10 March 1978 memorandum concerning
the Title IV Issues Paper prepared by your office that a new Section
421(a)(19) be added to allow the Agency to:
accept in the name of the Agency, and employ or dispose
of in furtherance of its functions, any money or property,
real or personal, received by gift, devise, bequest or
otherwise. '
2. The 5 U.S.C. 7342 provisions do not address the same issue as
is presented in the suggested 421(a) (19) . The former allows individuals
to accept gifts in compliance with its terms, the latter would allow the
Agency to accept gifts, etc., for its use. An example would be a bequest
of a private collection of rare books on intelligence for use as part of the
Historical Intelligence Collection. The proposed 421(a)(19) would allow
its acceptance and use by CIA without regard to arrangements otherwise
required to be made with GSA.
