This is one of the compelling reasons why access to sensitive information should be governed by a clear and demonstrable need for the information in the pursuit of the investigation. In this connection, your Special Counsel's willingness to clarify the relevance of several requests for such access is appreciated. 25X Approved For Release 2004/07108--: Ct , -RDP81 M009 0 Ik003300140024-5 25 I arts confident that both your Subcommittee's requir~eents and the DCI's responsibilities for protecting intelligence sources and methods f_ aa - e, t at my Leg~.slative Counsel is exp oring nson an the I]CI last November in connection with the Ethics Committee's II iri It is unA r. 4. di - * ~ h n the Memorandum of Understanding signed by Chairman Steve v d o a set of general principles and procedures as was accomp1is , bi - onz unauthorized disclosure can be met, -and our mutual, interest in eliminating unauthorized disclosures furthered. Mex.), who wrote to 3. the DCI to reiterate a staff request for CIA material ~LC_ MA~LiN wanted in connection with 4. Ethics Subcommittee investigations of unauthorized disclosures of intelligence s information. The reply expresses a desire to be cooperative, cautions 6. against the possibility of su investigations themselves jeopardizing sources and methods, and suggests the execution of a Memorandum of Understanding between the 8. Subcommittee and the DCI. The idea of a Memorandum of Understanding has already 9. been discussed with the Subcommittee's Special Counsel, who said he would 10. not object if we thought it necessary. 11. This letter has been coordinated with OGC, IG, and 12. 13. 14. 15. FORM 3-62 610 USE PRE EDITIONS rI_I p"~ E~-R f eas N (DENT AL USE ONLY UNCLASSIFIED 5 5 24 March 1978 27 March 78 Pat and I have met with Ethics Subcommittee Special Counsel Don Sanders. The Morgan/Schmitt Subcommittee is charged with carrying out the Ethics Committee's responsibilities regarding unauthorized disclosures, and we are thus likely to have a continuing relationshi O (The DCI's letter to SSCI Chairman Bayh on the 2 X leak could, for example, prompt a referral to Ethics, and hence to Sanders). We think a Memorandum of Understanding with the Morgan/ Schmitt Subcommittee is essential, and the attached Acting DCI respons to the Senators' letter suggests this. Such a MOU would, incidentally, provide another opportunity to attempt to establish OLC as an ILLS If intelligence community focal point. Background material is attached for your information.
