1. I regret I am without authority to establish the
Restored Leave Account of 72 hours requested in Reference C.
2. under the previsions of Reference (D) (paragraph 2d
(3) (a) (3).) Annual Leave forfeited because of an exigency
of public business is eligible for restoration only if
determination of the exigency is made in writing in advance
of or concurrently with the cancellation of leave by the
Deputy Director for Central Intelligence for the Office of
the Director. This very senior level of authority is a
substantive requirement necessary to conform with regulations
prescribed by the Civil Service Commission for administration
of the statue which authorizes restoration of leave.
3. Unfortunately the determination of the exigency and
cancellation of leave by r. George L. Cary does not qualify
the forfeited leave for restoration.
