SUBJECT: Revision of DCID 1/7
1. Action Requested: Your approval to circulate for
National Foreign Intelligence Board agreement a proposed
revision of DCID 1/7.
2. Background: DCID 1/7 provides security controls and.
markings governing the dissemination and use of intelligence
information. A proposed revision, agreed to by the DCI
Security Committee, is attached.
3. Discussion: Committee review of this directive con-
sidered w ether the DCID's controls were being properly used.
We concluded that variations in their use were due to inade-
quate or nonexistent tests for the governing circumstances.
The proposed DCID provides specific tests for the "Warning
Notice," "ORCON," "NO CONTRACT," and "Proprietary Infor-
mation" controls. The first two represent an ascending
hierarchy of security controls bounded by increasingly
stringent tests for their use.
The proposed revision also reflects changes in
Intelligence Community structure and terminology (E.O. 12036)
and in national security classification policy (E.O. 12065).
It is expressed in. simpler language than is the present
directive, and it drops a current control marking ("NFIB
Departments Only") that seems to serve no useful purpose.

The Committee deliberated at length on the NOFORN
control. Consideration was given to eliminating it in favor
of emphasizing the negative presumption that should govern
foreign release of U.S. intelligence. The consensus was that
the control should be retained, even though admittedly
redundant in many cases, as a visual reminder of the
sensitivity of some information and as a check against
unthinking release to third parties.
4. Recommendation: That you approve circulation to
the NFIB of the proposed revision. STAT

Here's a clean copy of the new draft of DCID
1/7 that we talked about on the phone just before
Christmas. Also a copy of Director's approval
to circulate the draft to NFIB. As I told you,
this draft was approved unanimously by ~ECOM;
but Murphy (OSD) may kick over the traces and
propose a different tack on NOFORN. If he does,
so be it, let's not encourage it. Hope this will
float through smoothly.

Revision of DCID 1/7
1. As you recall, the Compartmentation Subcommittee submitted
a proposed revision of DCID 1/7 last summer. By SECOM Staff
memo (SECOM-D-581), 24 July 1979, it was noted that Mr Gambino
had decided that too many questions had been raised on the
matter at the Security Committee level and remanded the pro-
posed DCID back to the Compartmentation Subcommittee for final
resolution and coordination.
2. The Compartmentation Subcommittee has subsequently held
several formal and informal meetings relative to this matter.
The attached proposed revision contains several changes that
are designed to take into consideration the additional recom-
mendations of several departments/agencies represented on the
Subcommittee.
3. The most significant issue concerned the "NOFORN" control
marking. During our deliberations it was recognized that the
marking was somewhat: redundant and tends to present a "negative
presumption" theory.
a. However, it should be remembered that DCID 1/7 permits
release of intelligence to foreign governments without permis-
sion of the originator under certain conditions (such as ex-
tracting or paraphrasing the information to insure that the
source cannot be deduced). CIA advised that there could be
information of such sensitivity that the originating authority
would want to pass judgment prior to any such release. The
NOFORN marking serves this purpose--a visual reminder. Addi-
tionally, there is the grave possibility of the incorrect re-
lease of intelligence furnished the US by a foreign government
to another foreign government in violation of an explicit under-
standing/liaison agreement with the foreign government originat-
ing the intelligence. Again, the NOFORN marking would provide
a guarantee and "flag" against such disclosure, regardless of
the circumstances.
b. For these and other cogent reasons, it is our recommen-
dation that the NOFORN marking continue to be authorized in DCID
1/7 as valid Intelligence Community marking on both hardcopy docu-
ments and electrical transmissions.

4. Other relatively minor changes were included in the
attached proposed revision of DCID 1/7. These included an
adjustment to Footnote 5 regarding the "ORCON" marking and
other changes made for editorial and clarity purposes.
5. All Compartmentation Subcomittee members have concurred
in the attached version of DCID 1/7. The Navy member advised
that the Navy prefers deletion of the NOFORN marking because
of the "negative presumption" theory; however, the Navy will
in the interest of expediting the revision, accept the
attached version.

1. Attached is the 2 October 1979 draft revision of DCID 1/7
which incorporates all changes agreed to at the 28 September 1979
meeting of the Subcommittee. For your convenience, the changes
are shown by a "bar" in the left margin of the affected pages.
2. As the 28 September 1979 meeting apparently resolved all Sub-
committee problem areas, it would appear that we can remand
the revision to the DCI SECOM for their action. Notation will
be made that the Subcommittee is in agreement with the 2 October
1979 revision and fully concurs in all portions, to include the
retention of the "NOFORN'.' control marking. It would be helpful if
youwould coordinate this matter with your SECOM member to preclude
any problem areas when the DCID is reviewed by the SECOM itself.
3. Please return your Vote Sheet Action on this matter to the
Executive Secretary of the Compartmentation Subcommittee by
19 October 19 79 .
