Proposed DCID No. 1/19
1. We have circulated for concurrence or comment
among the principal components of CIA the latest draft
(30 June 1976) of the proposed DCID No. 1/19, "Nondisclosure
Agreements for Intelligence Sources or Methods Information."
In this coordination process we also distributed copies of
reference memorandum, in which you outlined the comments
we had provided you earlier.
2. The results of this staffing reflect that CIA does
not concur in this latest draft, principally for two reasons:
a. The reaction throughout the Agency to
the proposed inclusion of a definition of intelli-
gence sources and methods was unanimously negative.
In addition to the reasoning we presented you
earlier against such inclusion (viz., that it would
ultimately inhibit us and place upon us the burden
of proving in each instance that a case in point
falls within the definition) comments received
suggested that a DCID is not the forum for intro-
ducing such a definition;
b. Notwithstanding our own attempt in the
Office of Security to reach a compromise on the
issue of exempting from labeling sensitive
compartmented information, the results of our
coordination reflected that there should be no
exemption of any kind from the labeling require-
ments of the proposed DCID; the reasoning dic-
tating against exemption is based on the fact that

the National Security Council implementing
directive for Executive Order 11652 requires
that intelligence sources or methods information
bear the warning notice.
3. CIA concurs in the introduction of the words
"or directly associated with" into paragraph 4, Labeling
Requirements.
4. Our Office of General Counsel notes that the
reference to the Atomic Energy Act in the footnote on
page 3 of the proposed DCID is incorrect. The language
of the citation should read "as defined in section 11 of
Public Law 83-703, the Atomic Energy Act of 1954."
5. As you are aware, CIA continues to feel strongly
that the DCID contain no reference to the security classifi-
cation of "intelligence sources or methods information."
