This Air Force request should be checked carefully as it probably will set a precedent for handling such requests in the future. 2. One possibility would be the approach used in the attached draft Secretary's Note to last Tuesday's Board meeting. The other alternative would be to treat the "originating agency" of NIE's and SNIE's as the DCI or CIA. This could be done on the argument that these were papers basically "produced" by the DC.I, in which the other USIB members concurred. Administratively it would be simpler for the requests for release to go only to CIA (e. g., OCR, O/NE or higher authority. Also it would eliminate the problem of CIA theoretically having to get USIB approval to pass any estimates to its contractors or, perhaps, "consultants" (if they are deemed to be "contractors" within the meaning of the policy paper. 3. The Air Force has requested that NIE 11-5-59, "Soviet Capabilities in Guided Missiles and Space Vehicles, " be released to the RAND Corporation. It has also certified to RAND"s need-to-know for this estimate, to be used in connection with certain long-range research studies RAND is conducting under an Air Force contract. Under the USI$-approved policy on release of intelligence to contractors of USIB organizations, NIE's and SNIE's will not be released to such contractors without the permission of the "originating agencyl (Attachment B to USIB-D-39. 5/2, 10 November, para. 3 j (4)). Inasmuch as this request involves a document produced by the DCI with the concurrence of the members of USIB, it appears appropriate to obtain Board clear- ance for this release. Accordingly, any member who objects or wishes to discuss this matter is requested to do so at the USIB meeting on 2 February. In the absence of such objection or request for discussion we will consider the Board has approved this release as of that date.
