SUBJECT: Parking Violations (Ref.

The receipt of the referenced note yesterday reminded STAT
me of an issue that I have wanted to raise for some time.
This seems the appropriate occasion.
I have never understood why the failure to display a
parking permit is a misdemeanor. Such a slip of memory
affects in no way the validity of the permission to park,
any more than forgetting to bring one's security badge to
the office rescinds one's permission to enter the building.
If a person has a parking permit, and his car is properly
parked, then failure to display-the permit can be no more
than an inconvenience to the police, which is surely no
misdemeanor. It is not the permit holder's responsibility
to prove that he is parked lawfully, since he knows he is;
it is the policeman's responsibility to prove that the
permit holder is in violation.
I think that when the police see a car without a
permit (and that otherwise isn't causing any problem)'they
should stick a notice on it saying what the problem is and
notifying the driver that he has, say, five working days
to appear before the authorities with proof that he had a
right to park where he was. Failure to appear before the
authorities or failure to offer satisfactory proof of
permission would then be a misdemeanor.
