IN THE HOUSE OF REPRESENTATIVES FEBRUARY 13, 1979 Mr. MINETA introduced the following bill; which was referred to the Committee on Public Works and Transportation A K BILL To provide for bicycle facilities in public buildings, and for other purposes. 1 Be it enacted by the Senate and House of Representa- 2 tives of the United States of America in Congress assembled, 3 That this Act may be cited as the "Federal Bicycle and 4 Physical Fitness Facilities Act". 5 SEC. 2. (a) The head of each department, agency, and 6 instrumentality of the Federal Government shall, not later 7 than one year after the date of enactment of this Act, require 8 bicycle parking facilities for use by employees and visitors at 9 all#kb IeA /at #95UJdk4Z6 aAMal r dM 0076-1 Approved Forlease 2004/04/15: CIA-RDP83-001500300010076-1 2 1 jurisdiction of such department, agency, or instrumentality. 2 The head of each department, agency, and instrumentality 3 shall require as a condition to any lease entered into after the 4 one-hundred-and-eightieth day after the date of enactment of 5 this Act for any building to be used for public purposes, that 6 bicycle parking facilities for use by employees and. visitors to 7 such building be provided by the lessor. To the extent practi- 8 cable and contractually feasible existing leases of buildings 9 for use for public purposes shall be renegotiated to provide 10 for bicycle parking facilities at such buildings. 11 (b) If the head of a department, agency, or instrumental- 12 ity provides a bicycle parking facility more elaborate than. a 13 simple rack a reasonable user fee may be charged for the use 14 of such system. If the head of a department, agency, or in- 15 strumentality provides separate locking devices a reasonable 16 deposit for use of such devices may be required. The head of 17 a department, agency, or instrumentality is authorized to 18 provide suitable support facilities for bicycle parking facili- 19 ties, including clothing, lockers, and changing facilities and 20 may charge a reasonable user fee for their use. 21 SEC. 3. Such facility shall include a 2 parking rack, lockers, or other device constructed to 3 enable the frame and both wheels of a bicycle to be 4 secured with ease in a manner to minimize the risk of 5 theft. 6 (2) The term "public building" means any build- 7 ing or part of a building owned or leased by any de- 8 partment, agency, or instrumentality of the United 9 States for use for any public purpose, which requires 10 either occupancy by employees or visitation by the 11 public, and to which employees or visitors might rea- 12 sonably choose to travel by bicycle. 0 Approved For Release 2004/04/15 : CIA-RDP83-00156R000300010076-1 Approved Fo0lease 2004/04/15: CIA-RDP83-001500300010076-1 96TH CONGRESS 1ST SESSION 4 To encourage bicycling and physical fitness by assuring greater safety for bicycles parked at Federal office buildings. IN THE SENATE OF ME UNITED STATES FEBRUARY 22, 1979 Mr. STAFFORD introduced the following bill; which was read twice and referred to the Committee on Environment and Public Works A ALL To encourage bicycling and physical fitness by assuring greater safety for bicycles parked at Federal office buildings. 1 Be it enacted by the Senate and House of Representa- 2 tives of the United States of America in Congress assembled, 3 That (a) the Administrator of the General Services Adminis- 4 tration (hereafter referred to as the "Administrator"), within 5 one year of the enactment of this Act, shall provide, at all 6 buildings and installations under his direction, bicycle parking 7 facilities for use by employees and visitors. Whenever the 8 Administrator fulfills the requirement of this Act by use of a 9 system that is more elaborate and costly than the use of a II Approved For Release 2004/04/15: CIA-RDP83-001568000300010076-1 Approved Fo0lease 2004/04/15: CIA-RDP83-0015x00300010076-1 2 1 simple metal rack, he is permitted to charge a reasonable fee 2 for the use of such system. 3 (b) The Administrator is also authorized, within a rea- 4 sonable period and where feasible, to provide suitable support 5 facilities, including clothing lockers and changing facilities,. 6 and to charge a reasonable use fee. 7 (c) For the purpose of this Act, the term "bicycle park- 8 ing facility" means a device or an enclosure, located within a 9 building or installation, or conveniently adjacent thereto, that 10 is easily accessible, clearly visible to guards, well-lighted, 11 and so located as to minimize the danger of theft of bicycles. 12 Such a device shall consist of a parking rack, locker, or other 13 device constructed to enable the frame and both wheels of a 14 bicycle to be secured with ease by use of a padlock in a 15 manner that will minimize the risk of theft. 0 Approved For Release 2004/04/15 : CIA-RDP83-00156R000300010076-1
