1. We have been reviewing Agency policies and procedures
concerning the processing of administrative tort claims
under the Federal Tort Claims Act. Our review has led us to
conclude that though OGC is responsible for the disposition
of administrative tort claims, there are no regulations
clearly indicating that we-have been charged with this
responsibility. Therefore, we propose the following amendment
tol
(2) FUNCTIONS . . .
(f) Be responsible for the adjustment, compromise,
settlement, or denial of any administrative
tort claim against the United States based
upon the act or omission of any Agency employee.
Also, should be amended to delete the confusing
reference to "claims" that appears in line 4 of subsection
(c).
2. Since this amendment would, in effect, delegate
certain DCI authorities, we believe that it should be
approved by the DCI. Please contact me so that we can
discuss this matter further.
