SUBJECT: Post Differential
REFERENCE: Memo to D/Pers from A/DDO; undated;
Subject: same (DD/O 79-2172)
1. In referent memorandum you recommended that procedures
be arranged to permit the payment of post differential, retro-
active to the date of arrival, to all Agency employees who are
sent on extended TDY to overseas hardship posts. Relative to
this recommendation, I have obtained from the Office of General
Counsel the attached opinion which indicates that such payment
would be contrary to the current provision of section 540 of
the Standardized Regulations and that the request does not
identify any cover, security or unique Agency-associated factors
which would support a conclusion that the use of the Agency's
Section 8 authorities would be necessary.
2. Based on the above opinion, I am unable at this time
to establish procedures for payment of post differential as
requested in referent memorandum. For your information, we
have made farther inquiry to the State Department's Allowances
Staff and have been advised that they presently have no plans
to change the 42-day waiting period or retroactive provisions
established in section 540 of the Standardized Regulations.
