SUBJECT: Briefing ofnthe President's Foreign Intelligence Advisory Board (PFIAB) re FOIA DATE: 22 May 1982 PLACE: Old Executive Office Building PARTICIPANTS: Robert J. Winchester, Chief, House Liaison Karen Davis, Office of General Counsel Admiral Thomas Moorer, Former Chief of Naval Operations and Advisor to President Reagan on Military Affairs Peter O'Donnell, Dallas Banker Robert Six, Continental Airlines 1. Upon the specific request of Admiral Moorer, the undersigned accompanied by met with members of the PFIAB listed above for purposes of providing them with a briefing as to the Agency's need for legislative relief under the Freedom of Information Act (FOIA). The briefing consisted of a point-by-point rundown of why the Agency is seeking FOIA relief as well as a review of the two possible avenues available for legislative relief. 2. With regard to the first matter, such items as incompatibility, admini- strative burden, perception, judicial review, benefits derived from FOIA to the American public, and the role of the Oversight Committees were discussed. Concerning the second matter, the undersigned outlined the basic parameters of the Administration-approved total exemption approach as well as S. 1273, the Chafee Bill. Messrs. Moorer, O'Donnell, and Six, who constitute some of the Members of the PFIAB's FOIA Subcommittee, were most grateful for the analysis and briefing. They appeared quite anxious to move the matter of FOIA legislative relief along but did see the need to time the release of the total exemption package so as not to conflict with efforts to have the Identities Bill finally enacted. Additionally, each of the PFIAB Members present noted that--in their individual capacities--they would personally make contact with Members of Congress whom they think will be favorable to our approach. The undersigned made available to the participants a copy of the "Comparison of Total FOIA Exemption vs the Chafee Approach" as well as a copy of the DCI's 21 September 1981 testimony before the Judiciary Subcom- mittee on the Constitution. All members present expressed their thanks for the briefing and the papers provided and seemed quite eager to have the Administration's FOIA package introduced with a view to garnering support in the 98th Congress.
