Fitzwater Deputy Director for Administration SUBJECT: Proposed special security invesLLgaLLvu~ ~a- 03~I5 1... Action Requested: Your approval of subject regulation (Attachment.1 . ?2. Background: The history of the proposed regulation is presented in my memorandum to the Deputy Director for Operations (DDO) dated 18 September-1981, provided for reference as Attach- ment 2. Subsequent action generated by the memorandum featured a cooperative effort by the Office of Security (OS) and the Office of,General Counsel (OGC) that resulted in the refined version of the proposal represented by Attachment 1. Through the good offices of of OGC, the latest version has been coordinated in orma y With the Counterintelligence Staff. The Staff understandably had an initial adverse reaction to a regu- latory issuance that had been perceived by the Directorate of Operations (DO) as inappropriate from the institutional stand- point. After study of the proposal, however, the Chief, Counterintelligence Staff, is not opposed to the provisions and substance of Attachment 1. 3. Staff Position: OS feels, and I agree,, that the proposal presents absolutely no threat to the DO mission or to information associated with the mission. Attachment 1 was drafted and refined with great care to ensure there was no infringement or suggestion of infringement on the exclusive authority of the DDO. The OS authority to pursue "special security investigations" is recognized but not documented. As you know, we are fortunate that only a few of these investigations are required, but those conducted are most significant. The Agency would benefit from an unequivocal policy statement documenting in the regulations the Agency's statutory requirement to investigate "security-approved personnel" who may be involved in espionage activities on behalf of a foreign power. b. The proposal in no way infringes upon the authority of the DO to engage in counterintelli- gence activities as defined in Executive Order 12333. c. Establishment of a time limit on "special security investigations," with the provision for extension as necessary, is prudent and fair. d. It is appropriate that the DCI, DDCI or Executive Director should approve and monitor "special security investigations." e. The current working relationship between the DO and OS on the matter at issue is affirmed rather than changed or expanded in either direction. 4. Recommendation: It is recommended that you approve .Attachment 1 and authorize immediate publication. H y E.
