SUBJECT: Weekly OGC Report for the DCI/DDCI
ITEMS OF MAJOR INTEREST - 3 - 9 APRIL 1982
Legislative Developments. House Intelligence Committee
Chief Counsel Mike O'Neil's assurances that he has no
intention of delaying completion of Conference action on
Identities legislation notwithstanding, House-Senate staff
meetings on the Conference reportedly have been acrimonious,
and progress toward narrowing issues has been limited. The
next staff level session is scheduled to take place on
Tuesday, 20 April. It appears that direct involvement of
the Members will be necessary to resolve the staff level
impasses.
The House Intelligence Committee has reported out
H.R. 6068, the Fiscal Year 1983 Intelligence Authorization
Bill. As we predicted earlier, the Bill contains a provision
which would adopt former spouses provisions similar to those
of the Foreign Service system for all CIA officers having at
least five years service overseas, whether such officers
participated in CIARDS or elected to remain in the Civil
Service System. The provision in the Authorization Bill
would also require that the former spouse have nied
the CIA officer overseas for at least five year
Executive Order 12356. The new Executive Order on
National Security Information, Executive Order 12356, was
signed by President Reagan on 2 April 1982. This Order
prescribes a uniform system for classifying, declassifying,
and safeguarding national security information and replaces
Executive
Order
12065 in this regard. The new Order is
primarily
based
on a draft prepared by an Intelligence
Community
group
chaired by this Agency's Deputy General
Counsel.
The new Order's objective is to enhance the
protection
afforded national security information relating
to our national defense and foreign relations, while continuing
to ensure necessary public access to this information when
disclosure will not damage the national security. Copies
of the new Order and a chart contrasting the provisions of
Executive Order 12065 and Executive Order 12356 and outlining
all of the major substantive revisions will be circulated
to all interested persons later this week

COMPTROLLER CHECKLIST
-- 84 Budget Review. Agency components have submitted the "base" request for
their 19814 budget--resources that are required to continue in 1984 the
capabilities they have today. Next week we will review these programs
with them, and the components will proceed with the development of the
remainder of the 1984 budget. Resources to provide additional capabil-
ities--initiatives--will be submitted in early May. 25X1
-- Budget Authorization. Last week the HPSCI marked up the Community budget,
and the SSCI neared completion of their markup.
The major House cuts
that
affect CIA are on covert action and personnel.
