Approved For Release 2005/08/02 CIA-RDP85-00375R000200090018-3 10 AUG 1982 MEMORANDUM FOR: Chief, Compensation Division/01' FROM: Chief, Benefits and Services Division INFORMATION: Chief, Communication Personnel Chief, Retirement Affairs Division/OP SUBJECT: Establishing 22 July, 1.982 10:30 a.m. As the Pay Cease 1. as involved in an automobile accident on 18 January 1982 while on official Agency business. He returned to work the next day but at 2:30 that afternoon went to the Agency Office of Medical Services from where he was transferred directly to Fairfax Hospital. From that point on he has not returned to work. Z. Based on the assumption that his absence from work was caused by a traumatic work related accident he was granted 45 calander days of traumatic leave. His entitlment to this leave was not controverted by the Agency on the C.A.--1 submitted in his behalf by the Office of Communication. The CA-1 was forwarded to the Department of Labor in a timely manner for processing by the Office of Workers' Compensation Programs (OWCP), 3. At the beginning of Leave Period 1, 1982, had an Annual Leave balance of 178 hours and a Sick Leave balance of 392 hours. During that leave period took 8 hours Annual Leave. The Pay Cease date was then computed by first granting the 45 calendar days of traumatic leave commencing at start of business 20 January 1982, followed by exhausting all accrued sick leave, followed by running down the annual leave to 160 accrued hours which permitted advancing 40 hours of sick leave which were then exhausted. As of 22 July 1982 10:30 a. m. had exhausted all sick and traumatic leave and had an annual. leave balance of 176 hours. 4. With 22 July 1982, 10:30 a.m. being established as the pay cease date the following actions are affected: a. The Office of Communication would submit Time and Attendance cards conforming to this schedule. b. The Retirement Operations Branch of the Office of Personnel would adjust date of retirement. c. Overshadowing all of the above is the ossib:il.ity that the Department of Labor may rule that claim is not supported with sufficient medical. evidence an ere ore denied by them. In this event the traumatic leave would be withdrawn and that amount of time, approximately 256 hours, would then be reflected as a period of overpayment. As of 6 August the Department of Labor was not willing to disapprove the use of traumatic leave or to project a date by which a final decision would be reached by them in this matter. 6.
