April 15, 1980 Mr. Stansfield Turner Director' Central Intelligence Agency Washington, D.C. 20505 ' DD/A This is in reply to your letter asking us to certify that the Central Intelligence Agency (CIA) has a priority allocation level of 100 percent of base period use not subject to an allocation fraction under the motor gasoline allocation regulations. Under Section 211.103(b)(l) of the Mandatory Petroleum Allocation Regulations, an allocation level for motor gasoline of 100 percent of base period use, not subject to the supplier's allocation fraction, is specifically accorded to Department of Defense use for essential military and readiness-oriented operations. The CIA. is part of "governmental use" in a lesser priority category. This category applies only to the extent that the CIA is a wholesale purchaser-consumer or bulk purchaser.
