SUBJECT: Review of S.2236, An Act to Combat Inter-
national Terrorism
1. (C) We have reviewed the subject proposed act and
our comments follow. We assume that this act applies to the
U.S. Government, including the Central Intelligence Agency (CIA) and
the Department of Defense-(DOD)

b. This act will dilute Agency attempts to deny
involvement in PM activities because of requirement
for indentification and detection taggants.
c. It will prohibit the transport and exportation
of Agency and DOD stocks after a 2 - 3 year period, or
require the modification of all existing stocks which
is considered impractical.
2. (C) This act does not clearly define explosives. We
beli"eve the intent is to apply taggants only to common explosive
compounds found in configurations such as blocks, stick, powder
form and grains but not to include explosives encased in mediums
such as land mines, grenades, mortar rounds, artillery shells,
et cetera.. If these articles are included, this act may have an
effect on our foreign explosive ammunition in our contingency
stockpiles.

Please put the following on the routing sheet when you
forward Supply Division's comments on the Act to Combat
International Terrorism:
"Attached are OL comments relative to ordnance,
storage, and transportation problems which might be
caused by the Explosive Taggants provision in the
proposed Senate Bill --An Act to Combat International
Terrorism. It is suggested that you may want to
solicit comments from SOG with regard to the impact
that this bill might have on special operations.
It is hoped that the Senate staffers could prepare
a list of specific questions of interest with regard
to the effect on CIA of this proposed act. Absenting}
specific questions, OL will be happy to nominate a
representative to discuss shipping and storage impact.
It is suggested that an SOG representative address
the Agency's position relative to operational utili-
zation and deployment.
A copy of this note, the attached OL comments,
and the draft act have been forwarded to SOG."
