SUBJECT Sunset Legislation, S. 2, H.R. 2 and H.R. 65
REFERENCE OLC 79-0917
1. On 9 March 1979 this office forwarded copies of S. 2
and H.R. 2 requesting comments by COB, 30 March 1979. We
also noted in reference memorandum that the bills could begin
moving at anytime. This is in fact the case.
2. The Office of Management and Budget (OMB) has requested
our views ASAP on H.R. 2 and H.R. 65 (the latter attached).
The House Rules Committee is hoping to clear the bills by
mid-April. Accordingly, OMB has indicated that individual
departments or agencies must get their comments submitted so
that the Administration which in theory supports the
Sunset concept -- can speak to specific changes in the
legislation to cover individual Executive Branch agency
problems. In order for us to effectively respond to OMB we
would request that the 30 March deadline be changed to COB,
Monday, 26 March 1979.
3. Please be sure to include H.R. 65 in your review. A
quick review of the bill by this office reveals that Sections
101, 102 and 201 are particularly troublesome in that they
would require disclosure of intelligence information re the
Agency's most sensitive programs.
4. We regret the inconvenience caused by the new deadline
but would hope that you could give us the benefit of your
analysis by the date indicated above. Please send your
STAT comments tol of my staff.
