IN THE HOUSE OF REPRESENTATIVES MAY 9, 1979 Mr. ANDERSON of California introduced the following bill; which was referred to the Committee on Government Operations A BILL To reduce the annual automotive mileage and fuel consumed by Federal agencies. 1 Be it enacted by the Senate and House of Representa- 2 tines of the United States of America in Congress assembled, 3 SHORT TITLE 4 SECTION 1. This Act may be cited as the "Federal 5 Automobile Mileage Reduction Act of 1979". 6 STATEMENT OF PURPOSE 7 SEC. 2. The purpose of this Act is to reduce the annual 8 automotive mileage and fuel consumed by Executive 9 agencies. 10 SEC. 3. For purposes of this Act- Approved For Release 2005/05/17 : CIA-RDP85-00988R000200140003-3 .4027 Approveci For Release 2005/05/17 : CIA-RDP85-009 8R000200140003-3 2 1 (1) The term "automobile" means any vehicle 2 which has four or more wheels, propelled by fuel, and 3 which is manufactured primarily for use on public 4 streets, roads, and highways (except any vehicle oper- 5 ated on rail or rails). 6 (2) The term "fuel" means gasoline and diesel oil. 7 The President may include any other liquid fuel or gas- 8 eous fuel within the meaning of the term "fuel" if he 9 determines that such inclusion is consistent with the 10 need to conserve energy. 11 (3)(A) The term "base period automobile usage" 12 means, with respect to any Executive agency in exist- 13 ence on September 30, 1977, the aggregate number of 14 miles traveled by automobiles owned, or leased for 15 more than six months, by that agency during the fiscal 16 year ending September 30, 1978. 17 (B) In the case of any agency which was not in 18 existence on September 30, 1977, such term means 19 the aggregate number of miles which the President de- 20 termines would have been traveled by automobiles 21 owned, or leased for more than six months, by that 22 agency if the agency had been in existence on that 23 date, taking into account the automobile usage attrib- 24 utable to functions transferred to or vested in that 25 agency. Approved For Release 2005/05/17 : CIA-RDP85-00988R000200140003-3 Approved For Relye 2005/05/17 : CIA-RDP85-00988R00W0140003-3 3 1 (C) The base period automobile usage for any 2 agency shall be adjusted by the President for changes 3 in functions or levels of workload occurring after Sep- 4 tember 30, 1978; except that the aggregate of the base 5 period automobile usage for all agencies at any time 6 may not exceed the aggregate of all Executive agen- 7 cies for the fiscal year ending September 30, 1978. 8 (4) The term "Executive agency" has the mean- 9 ing given such term in section 105 of title 5, United 10 States Code, except that it shall include the United 11 States-Postal Service and the Postal Rate Commission. 12 LIMITATION ON AUTOMOBILE TRAVEL 13 SEc. 4. (a) The President shall provide that the aggre- 14 gate miles traveled by automobiles owned, or leased for more 15 than six months, by any Federal agency in each fiscal year 16 beginning after September 30, 1979, shall be equal to or less 17 than that agency's base period automobile usage reduced as 18 provided in subsection (b). 19 (b)(1) In the case of any fiscal year beginning after Sep- 20 tember 30, 1979, and before October 1, 1993, the reduction 21 in each Executive agency's base period automobile usage 22 shall be determined under the following table: For the fiscal year ending: The base period automobile usage shall be reduced by: September 30, 1980 ............................. 6 percent. September 30, 198.1..; ........................... 8 percent.. September 30, 1982 9 percent. September 30, 1983 ............................. 10 percent. Approved For Release 2005/05/17 CIA-RDP85-00988R000200140003-3 Approver Release 2005/05/17 : CIA-RDP85-8R000200140003-3 4 For the fiscal year -ending: The base period automobile usage shall be reduced by: September 30, 1984, and thereafter 11 percent plus 1 percentage point for through September 30, 1993. each fiscal year after 1984. 1 (2) In the case of any fiscal year beginning after Sep- 2 tember 30, 1993, each Executive agency's base period auto- 3 mobile usage shall be reduced by 20 percent, plus such addi- 4 tional amount as the President determines possible without 5 adversely affecting the capability of that agency in carrying 6 out its functions. 7 (c) In addition to the preceding requirements of this sec- 8 Lion, the President shall provide- 9 (1) that the travel by each Executive agency in- 10 volving the reimbursement for use of employee-owned 11 automobiles or the rental, or lease for periods less than 12 six months, of automobiles does not exceed the travel 13 by that agency involving such reimbursement, rental, 14 or lease which occurred during the fiscal year ending 15 September 30, 1978, or if the agency was not in exist- 16 ence on September 30, 1977, which the President de- 17 termined would have occurred if it were in existence 18 that year. 19 EXEMPTIONS 20 SEc. 5. (a) The President may exempt the travel of any 21 automobile or automobiles of an Executive agency during 22 any national emergency or disaster to the extent necessary to 23 respond to that emergency. Approved For Release 2005/05117 : CIA-RDP85-00988R000200140003-3 Approved For Relgse 2005/05/17: CIA-RDP85-00988RO 00140003-3 5 1 (b) The President may exempt automobiles owned or 2 leased by the United States Postal Service to the extent he 3 considers such exemption necessary in order for the Postal 4 Service to effectively carry out its responsibilities. 5 (c) After September 30, 1983, the President may 6 exempt for one year any Executive agency, to the extent he 7 considers such exemption necessary in order for such agency 8 to effectively carry out its responsibilities. No exemption 9 under this subsection may permit an Executive agency's 10 automobile usage to increase in any fiscal year over the mile- 11 age limitation for the preceding fiscal year applicable to that 12 agency (determined without regard to this section). 13 (d) The President shall transmit to each House of the 14 Congress a written report not later than sixty days after an 15 exemption has been made under this section (excluding Sat- 16 urdays, Sundays, and legal holidays in the District of Colum- 17 bia). 18 GASOHOL USAGE 19 SEC. 6.
