Approve /11I~-096 10010069-4 MEMORANDUM FOR: Chief, Plans and Programs Staff, OL FROM: Chief, Supply Division, OL SUBJECT: Review of Intelligence Charter Legislation Issues Paper We have reviewed the "Issues Paper" and the following represents our response to those areas in which the Supply Division is involved. No reference is made to subjects not applicable to our function. Issue 10 - The reference to Section 413(a)(2) should read 413(g)(2). In this regard, as we have stated previously, we feel that the word "service" should be defined. It could pertain to an intelli- gence or operational need or to an administrative or logistical function. Issue 16 - We concur that the paragraph contained in 1-812 should be included at the end of Section 413. Issue 19 - We recommend that the following be a added to Section 421(a)( and manage supply system to support operations. SUBJECT: Review of Intelligence Charter Legislation Issues Paper Issue 21 - We agree that a new subsection is needed but suggest the following wording: "Dispose of property and use the proceeds therefrom to purchase new property notwithstanding the provisions of [cite relevant law] and to release excess property on a nonreimbursable basis to a foreign government when the Director deems such actions necessary to the successful performance of the functions of the Agency or to protect the security of Agency activities." Issue 24 - We agree with the rewording of 24b but suggest it should be extended to include the transportation and utilization of firearms for authorized training. In addition, we are unaware of the firearms proposal submitted to the Office of Management and Budget as cited in 24e. Issue 26 - The procurement authority provided in Section 422 is sufficient to cover our procurement activities. Under Section 422(a), we recommend that the wording of the first sentence, lines 19 - 22, be reworded to state: "The Agency is authorized to procure such property, supplies, services, equipment, and facilities from commercial sources and other Governmental agencies as may be necessary to carry out its functions under this act." Issue 27 - It is felt that the provisions of Section 139 will hamper our procurement activities if ad hoc approvals must be obtained in each instance when it is decided that the Agency interest will not be disclosed. However, until specific procedures are approved by the Attorney General, we cannot determine the impact of this issue.
