1. Action Requested: Your personal approval and personal
revalidation of subject regulations (attachments).
2. Background: are the basic Agency
regulations governing t e use o Agency firearms. These regula-
tions were drawn pursuant to the common law authority of the
U. S. Government to protect the security of its property and
personnel. The Office of General Counsel (OGC) concluded that
while the Agency's only explicit firearms authority was the
statutory authority of its couriers and guards to carry firearms
to protect classified documents in transit, that did not prevent
the Agency from using its common law firearms authority to pro-
tect its personnel and property in other situations.
The Intelligence Authorization Act of 1982 broadens the
Agency's statutory firearms authority contained in the Central
Intelligence Agency Act of 1949 by giving the Director of Central
Intelligence (DCI) explicit authority to designate personnel to
carry firearms in performing Agency functions. Legally sufficient
implementation of this legislation require -
