Addabbo Committee on Small Business House of Representatives Washington, D.C. 20515 Dear Mr. Addabbo: I am writing in response to your letter of 11 July 1983 to the Di Central Intelligence, Mr. William J. Casey, regarding , Spacesaver Systems, Inc. This is to advise you t a concerns are presently before the General. Accounting Office (GAO) for review as'a formal Bid Protest. The Comptroller General is investigating the matter and will respond to appropriate. To assist you in your investigation of this award, I am enclosing a copy of the Agency's 5 July 1983 Bid. Protest Report filed with the GAO relatin to CIA RFPa83A-160. inter- d to id e same report has been prov .ested parties. In answer to questions, we can assure you that Agency technical specs ications were not altered to protect Remco Corporation, the successful bidder, or for any other improper purposes. More specifically, our tight dead- line for contract performance was imposed because of the date scheduled for occupancy of the building. When construction difficulties delayed the date the building would be available for occupancy, our requirement for expedited performance ceased to exist. Simply stated, our tight deadline for contract performance was relaxed, not out of concern for Remco or any other bidder, but because the building occupancy date was delayed due to construction problems, thereby elimi- nating the need for the tight deadline originally required. I --I These specifications were amended seven times, each on the basis of recommendations from our contracting and technical components. We wish to emphasize that these amendments were issued in order to ensure the suitability of the product and to remove ambiguities from the solicitations. As mentioned previously, these matters and several other relevant questions are presently before the Comptroller General for review, and further elaboration on the facts at this time may be inappropriate pending a decision by the Comptroller General. I trust the foregoing is responsive to your inquiry and will provide some reassurance to your con- stituent that his interests were properly safeguarded by this Agency.
