As explained in a telephone conversation between Mr. and the undersigned on 21 February 1980, the Office o Communications (OC) required additional time to examine the voluminous material covered in the draft National Intelligence Act of 1980. Following our review of the package, we have concluded - as mentioned in the conversation referred to above - that the draft is acceptable except-for certain language contained in Title VI. 2. We were pleased to see that this latest version of the Bill remedies many of the problem areas of Title VI which OC identified in earlier versions; however, not all of the shortcomings have been corrected. Some wording contained in Sections 613(a)(14) and 641(d)(1), which had been identified as problematical nearly two years ago, remains basically unchanged. Also, if the words "coordinate," "consultation," "review," and "guidance" are to be interpreted as elements of control, then Section 641(d)(1) may be considered to provide the Director of NSA with such control over certain CIA functions. 3. OC has particular concern for the wording used in Section 641(d)(1), which requires that CIA allow the Director of NSA to review unique COMSEC methods and procedures in support of clandestine activities.
