SUBJECT : Payroll Allotments for Insurance Purposes
1. This is in reply to your memorandum of 3 December, subject
as above, in which you request us to determine from the State
Department the authority and basis for the payroll allotments for
insurance premiums mentioned in the Phoenix Assurance Company of
New York booklet., which your memorandum forwarded.
2. 1 have discussed this matter with a member of the Office
of the Lec;al Advisor of the Department of State. He said he of
course could not speak for the Phoenix Assurance Company or Marsh
and McLennan, Inc. He stated the Department does provide for salary
allotments for insurance premiums under Section 75(e) of Title 5 of
the United States Code for officials and employees assigned outside
the continental limits of the United States. He knows of no authority
for such action with respect to persons assigned within the United
States, and so far as he knows, allotments from the salaries of such
persons in fact are not made. See also our memorandum to you of 28
August 1959, and the Comptroller General decisions cited therein.
