Analysis. This bill would amend the Small Business Act to require
federal agencies to increase the amount of procurement contacts set
aside for small business and to target that set aside on areas with
high unemployment.
It is possible that the Agency would object to this legislation
as creating a burden on its procurement processes. It dMNXXM9X
appears,however, from the lack of sponsors, that bill will not see action.
I will, nevertheless, continue to follow the bill to insure that
it does not see action. If it apppears to be moving, then we will have
to determine what sort of action to take to remove Agency objections.

the ten States having the highest rates of unemployment by
increasing for a three-year period the Federal procurement
set-asides for small businesses doing business in any such
State.

4 SECTION 1. This Act may be cited as the

1 PURPOSE
2 SEC. 2. The purpose of this Act is to expand the small
3 business set-aside program in high unemployment States
4 by-
5 (1) increasing by 5 percentage points the goal of
6 each Federal agency for the participation by small
7 business concerns in procurement contracts of such
8 agency having values of $10,000 or more, and
9 (2) giving priority to small business concerns lo-
10 cated in the ten States having the highest rates of un-
11 employment for contracts set aside over and above ex-
12 isting goals for such participation.
13 AMENDMENT OF SMALL BUSINESS ACT
14 SEC. 3. (a.: Sobsection- (g) of section 15 of the Small
15 Business Act is amended by adding at the end thereof the
16 following:
17 "(2) In the case of procurement contracts having values
18 of $10,000 or more which are awarded during the three-yedr
19 W beginning on the date of the enactment of this paraq
20 graph, it'll be the goal of each Federal agency to provide
21 fic the participation by small business concerns (and by small
22 business concerns owned and controlled by socially and eco-
23 nomically disadvantaged individuals) an additional 5 por
24 cep of such procurement contracts of such agency.

1 "(3)(A) Small business is located the
2 t shall be
3 given priority in the awarding of contracts, and the place-
4 ment of subcontracts, which are set aside by reason of para-
5 graph (2).
6 "(B) The priority required under subparagraph (A) shall
7 be taken into account before the application of subsections
8 (d), (e), and (f).
9 "(4) For purposes of paragraph (3), the unemployment
10 rates which shall apply to contracts set aside during a calen-
11 dar year shall be the average of the monthly unemployment
12 rates for each State for months of the preceding calendar
13 year.".
14 (b)(1) Subsection (g) of section 15 of the Small Business
15 Act is amended by striking out "(g)" and inserting in lieu
16 thereof "(g)(1)".
17 (2) The second sentence of paragraph (1) of section
18 15(g), as redesignated by paragraph (1) of this subsection, is
19 amended by striking out "subsection" and inserting in lieu
20 thereof "paragraph".
21 (c) The amendments made by this Act shall apply to
22 contracts set aside during the three-year period beginning on
23 the date of the enactment of this Act.
