Under a CBS discovery motion, we searched our files for documents
relating to the process of estimating Viet Cong and North Vietnamese
military strength in South Vietnam during the period 1966-68. The
motion arose from the lawsuit against CBS brought by General
William C. Westmoreland.
Of the documents found, 22 were of interest to the Department
of State. One, number 417 of our CBS Project, is sent for your
review and coordination. It is a USIB memo No. dated
3 February 1967, Subject: Status of North Vietnam Infiltration
Into South Vietnam. Attached to it is a DIA memo No.
dated 3 February 1967, Subject: Status of North Vietnam Infiltration
Into South Vietnam which is classified TOP SECRET/TRINE. This docu-
ment is also being coordinated with NSA, DIA, and DOD (OSD/JCS).
The remaining 21 documents of interest to the Department are
CBS Project numbers 420 through 440. We have no objection to their
declassification and refer them to you for review. Accompanying
these documents is a computerized list of them for record purposes.
We would appreciate your returning the documents and the results
of your reviews to us, so that we may coordinate the release of
all documents found in CIA files to both parties in the suit.
