c. Office Of Data Processing (ODP) Request for Proposal (RFP):
On 23 January 1984, RFP 84B-236, entitled System Development
Enhancement, was issued to 16 prospective offerors. This require-
ment includes a collection of non-related computer applications
which support Computer Applications Systems Life Cycle activities
in the Office of Data Processing, Systems Development Division
(ODP/SDD). Intentions to bid are due on 10 February 1984. To date
only one vendor (American Management Systems, Inc.) has declined to
bid.
d. Meeting Between XEROX And Automatic Data Processing and
Engineering Branch ADP&EB PD OL : On 31 January 1984, Agency and
Xerox Corporation representatives met to discuss the Government's
application of the contract provision entitled "Rights in Technical
Data and Computer Software" to the "Analyst" software developed
under various Agency Contracts. In the course of this meeting,
Xerox stated that the deliverables in question included Restricted
Rights legends pursuant to the reference provision. However, on the
basis of a Contract Officer query of Contracting Officer's Technical
Representative (COTR's) prior to this meeting, such was determined
not to be the case. ADP&E/PD/OL has again queried all concerned
representatives and, until this question of fact is resolved, Agency
employees passing this data to third parties have been advised they
must obtain nondisclosure agreements. A second issue discussed
during the negotiations is the Agency equity versus Xerox equity in
the "Analyst." These negotiations are expected to culminate in an
agreement by the end of February.
